TSA justifies pat downs with op-eds \u2014 is my paper trail to blame?<\/a><\/h1>\n

Americans love to grouse about the Transportation Security Agency. I have caterwauled as loudly as anyone over the years. But I learned last week that some of TSA\u2019s absurdities might be my fault.<\/p>\n

TSA is proud of its 2600 Behavior Detection Officers (BDOs) who lurk in airports surveilling how travelers swallow, sweat, and blink. \u00a0The Government Accountability Office walloped the program last week in a report on the official TSA \u201cindicators\u201d of terrorist intent <\/a>that BDOs ferret out. \u00a0GAO concluded that 98 percent of the studies TSA invoked failed to provide \u201cvalid evidence\u201d to support TSA\u2019s claims. \u00a0Even more stunning, almost 80 percent of the \u201csources\u201d TSA invoked were \u201cnews or opinion pieces,\u201d <\/a>all of which GAO dismissed as invalid.<\/p>\n

TSA refuses to disclose the list of those articles it offered to GAO so I don\u2019t know if any of my pieces were used to justify its standards. In a 2004 New York Times oped<\/a>, I lamented that TSA agents were looting checked baggage. More than 500 TSA employees <\/a>have since been fired for stealing travelers\u2019 property. \u00a0Two years ago, I pointed out in USA Today that dozens of TSA behavior detection agents in Boston complained <\/a>about the use of nitwit terrorist profiles such as black guys wearing baseball caps backward or Hispanics traveling to Miami. At the Newark airport, TSA behavior detection officers <\/a>fabricated false charges against illegal aliens to boost the program’s arrest numbers.<\/p>\n

After TSA\u2019s secret list of terrorist traveler traits leaked out, I mocked the BDOs targeting people who were yawning, hand wringing, and gazing down<\/a>. My favorite TSA warning sign was “excessive complaints about the screening process” <\/a>\u2014 which explains why TSA agents often treat me like an al Qaeda operative. \u00a0No wonder TSA chief John Pistole denounced <\/a>me for disparaging and maligning TSA employees.<\/p>\n

TSA recently reduced the number of terrorist warning signs from 94 to 36<\/a>, but there are still some howlers in the mostly-secret list \u2014 including \u201csweating heavily\u201d (for which TSA offered 63 invalid studies). GAO also scoffed <\/a>at the notion that TSA agents could detect terrorists by \u201cassessing the way an individual swallows or evaluating the degree to which an individual\u2019s eyes are open.\u201d<\/p>\n

TSA was undaunted by GAO\u2019s drubbing. \u00a0The agency vindicated itself by trumpeting how BDOs watch out for \u00a0\u201cunusual exposed wires or electrical switches on a person<\/a>\u201d seeking to board a plane. \u00a0\u00a0But do we need a special TSA program to recognize would-be terrorists who received all their \u201ctraining\u201d from Road Runner cartoons featuring Wile E. Coyote assembling an Acme Bomb Kit?<\/p>\n

TSA could not provide a single example of its elite corps thwarting a threat to civil aviation. \u00a0However, TSA proudly cited one case <\/a>\u201cwhere TSA\u2019s behavior detection activities led to the identification of an individual attempting to conceal illegal drugs at an airport screening checkpoint.\u201d \u00a0Since this particular program has cost more than a billion<\/a> since 2007, this could be the most expensive drug seizure in U.S. history.<\/p>\n

TSA recently modified operations to occasionally assign BDOs to other TSA activities where they continue to exploit their \u201cbehavior detection capabilities<\/a>.\u201d \u00a0But those 34 warning signs will continue to vex hapless travelers. \u00a0TSA still classifies all details about terrorist swallowing as a state secret. (The Homeland Security Inspector General slammed TSA <\/a>for \u201cunjustifiable and inconsistent and arbitrary\u201d use of the \u201csensitive security information label\u201d to shroud its policies and blunders.)<\/p>\n

Since TSA was created in 2002, Americans have perennially been assured that the agency is smarter than it looks. Last week\u2019s GAO report is a reminder that there is often nothing behind the curtain of harebrained policies except for bogus claims and hackneyed oped pieces. Regardless, I will be more careful about what I write about the agency.<\/p>\n
