(You&#8217;re next Florida)<\/a><\/h1>\n<\/section>\n<section id=\"module-position-QOkYZ6eT7Wk\" class=\"storytopbar-bucket story-byline-module story-story-byline-module\">\n<div class=\"asset-metabar\"><span class=\"asset-metabar-author asset-metabar-item\">James Bovard, Opinion columnist <\/span><span class=\"asset-metabar-time asset-metabar-item nobyline\"><span class=\"asset-metabar-time-updated\">Sept. 1, 2017<\/span><\/span><\/div>\n<\/section>\n<section id=\"module-position-QOkYZ6fv3xU\" class=\"storytopbar-bucket piano-module story-piano-module\"><\/section>\n<section id=\"module-position-QOkYZ6eAiSs\" class=\"storytopbar-bucket bounce-exchange-module story-bounce-exchange-module\"><\/section>\n<section id=\"module-position-QOkYZ6eXp94\" class=\"storytopbar-bucket google-survey-module story-google-survey-module\"><\/section>\n<div class=\"asset-double-wide double-wide p402_premium\" role=\"main\">\n<div id=\"module-position-QOkYZ6lQzaQ\" class=\"story-asset story-leadin-asset\">\n<h3 class=\"lead-in\">The &#8216;flood-build-repeat&#8217; model, so popular among re-election-seeking members of Congress, must come to an end.<\/h3>\n<\/div>\n<\/div>\n<p class=\"speakable-p-1 p-text\"><a href=\"https:\/\/www.usatoday.com\/story\/weather\/2017\/08\/30\/harvey-costliest-natural-disaster-u-s-history-estimated-cost-160-billion\/615708001\/\">Hurricane Harvey<\/a>, which battered Texas over the <a href=\"http:\/\/www.cnn.com\/2017\/08\/25\/us\/hurricane-harvey\/index.html\">past week<\/a>, offers the clearest lesson why Congress should not perpetuate the federal <a href=\"http:\/\/www.insurancejournal.com\/news\/national\/2017\/08\/28\/462472.htm\">National Flood Insurance Program<\/a> (NFIP), which expires at the end of September. The ravages in Houston and elsewhere would be far less if the federal government had not offered massively subsidized flood insurance in high risk, environmentally perilous locales. But this is the same folly that the feds have perpetuated for almost 50 years.<\/p>\n<p class=\"speakable-p-2 p-text\">Two years before NFIP was created, the 1966 Presidential Task Force on Federal Flood Control Policy warned that a badly run program \u201ccould exacerbate the whole problem of flood losses. For the Federal Government to subsidize low premium disaster insurance &#8230; would be to invite economic <a href=\"https:\/\/financialservices.house.gov\/uploadedfiles\/hhrg-113-ba04-wstate-sellis-20141119.pdf\">waste of great\u00a0<\/a><span style=\"color: #009bff;\">magnitude<\/span>.\u201d That sage advice was ignored.<\/p>\n<p>Instead, NFIP embraced a \u201cflood-rebuild-repeat\u201d model that has spawned an almost <a href=\"http:\/\/thehill.com\/blogs\/pundits-blog\/economy-budget\/316981-the-federal-flood-insurance-program-is-drowning-in-debt\">$25 billion debt<\/a>. The <a href=\"https:\/\/www.nwf.org\/~\/media\/PDFs\/Water\/199807_HigherGround_Report.ashx\">National Wildlife Foundation<\/a> estimated in 1998 that 2%\u00a0of properties covered by federal flood insurance had multiple damage claims accounting for 40% of total flood insurance outlays, and that more than 5,000 homes had repeat claims exceeding their property value.\u00a0A recent Pew Charitable Trust study revealed that <a href=\"http:\/\/www.pewtrusts.org\/en\/multimedia\/data-visualizations\/2016\/repeatedly-flooded-properties-cost-billions\">1%\u00a0of the 5 million properties<\/a> insured have produced almost a third of the damage claims and half the debt.<\/p>\n<p class=\"p-text\">NFIP paid to rebuild one Houston home <a href=\"http:\/\/www.shfwire.com\/new-bills-seeks-limit-repeat-flood-damage-claims\/\">16 times in 18 years<\/a>, spending almost a million dollars to perpetually restore a house worth less than $120,000. Harris County, Texas (which includes Houston), has almost 10,000 properties which have filed <a href=\"http:\/\/www.houstonchronicle.com\/business\/article\/Flood-insurance-program-deep-in-debt-costs-will-11009266.php\">repetitive flood insurance damage<\/a> claims. The Washington Post recently reported that a house \u201coutside Baton Rouge, valued at $55,921, has <a href=\"https:\/\/www.washingtonpost.com\/national\/health-science\/the-countrys-flood-insurance-program-is-sinking-rescuing-it-wont-be-easy\/2017\/07\/16\/dd766c44-6291-11e7-84a1-a26b75ad39fe_story.html?utm_term=.1f8f32135bb6\">flooded 40 times<\/a> over the years, amassing $428,379 in claims. A $90,000 property near the Mississippi River north of St. Louis has flooded 34 times, racking up claims of more than $608,000.\u201d<\/p>\n<p class=\"p-text\">When NFIP was created, one of its purported goals was to deter development in fragile areas such as coastal wetlands. However, as Steve Ellis of Taxpayers for Common Sense observed, &#8220;NFIP helped <a href=\"https:\/\/financialservices.house.gov\/uploadedfiles\/hhrg-113-ba04-wstate-sellis-20141119.pdf\">fuel the coastal development<\/a> boom that increased the program&#8217;s risk exposure and losses.&#8221; The program\u2019s anti-environmental impact has been denounced by organizations ranging from the <a href=\"https:\/\/www.nrdc.org\/experts\/rob-moore\/flood-rebuild-repeat-need-flood-insurance-reforms\">Natural Resource Defense Council<\/a>, <a href=\"https:\/\/www.fema.gov\/media-library-data\/20130726-1602-20490-6225\/nfip_eval_dei_literature_review.txt\">Sierra Club<\/a>, <a href=\"https:\/\/www.americanrivers.org\/2016\/04\/nfip-endangered-species\/\">American Rivers<\/a>, and the <a href=\"https:\/\/fee.org\/articles\/uncle-sams-flood-machine\/\">Coastal Alliance<\/a>.<\/p>\n<div class=\"teads-inread\">\n<div>\n<div id=\"teads0\" class=\"teads-player\">Rather than encouraging reasonable land use policies, NFIP subsidies help level the playing field between swampland and solid ground. For instance, Houston residents outside a too narrowly-drawn floodplain can receive <a href=\"http:\/\/www.houstonchronicle.com\/business\/article\/Flood-insurance-program-deep-in-debt-costs-will-11009266.php\">$350,000 in insurance coverage<\/a> for only $450 a year. But there is no reason for federal intervention to encourage building in every dubious nook and cranny across the land \u2014\u00a0or in areas such as the low-lying Texas Gulf coast repeatedly ravaged by bad storms.<\/div>\n<\/div>\n<\/div>\n<p class=\"p-text\">Controversies over environmental havoc and \u201crepetitive loss\u201d sinkholes finally spurred Congress to radically <a href=\"https:\/\/www.congress.gov\/bill\/112th-congress\/house-bill\/1309\">reform flood insurance<\/a> five years ago, ending some of its worst abuses. But prudence proved unbearable on Capitol Hill. After homeowners wailed about higher insurance rates, Congress <a href=\"http:\/\/www.npr.org\/2014\/02\/27\/283157860\/overhaul-of-a-fema-program-has-homeowners-calling-congress\">gutted most of the reforms<\/a> two years later to prevent the program from charging fees to accurately reflect perils.<\/p>\n<p class=\"p-text\">Politicians insisted that the repeal was necessary to preserve \u201caffordable\u201d flood insurance. But nobody was conscripted to buy a vacation home in Hurricane Alley on the Atlantic Coast. Flood insurance subsidies <a href=\"http:\/\/repository.law.umich.edu\/cgi\/viewcontent.cgi?article=2751&amp;context=articles\">benefit well-off households<\/a>, and payouts disproportionately go to areas with much higher than average home values. Working stiffs in Idaho and Oklahoma are taxed to underwrite mansions for the elite.<\/p>\n<p class=\"p-text\">FEMA is relying on maps that are up to 40 years old to calculate flood risks in many areas. FEMA has loitered on updating in part because many members of Congress vehemently <a href=\"http:\/\/www.pwmag.com\/administration\/gis-asset-management\/congress-continues-to-stall-updates-to-floodplain-maps_o\">oppose accurate estimates<\/a> of the risks and updated, higher insurance rates for their constituents. According to FEMA flood insurance specialist David Schein, \u201c<a href=\"http:\/\/www.chicagotribune.com\/business\/ct-northern-illinois-flooding-insurance-0720-biz-20170717-story.html\">Grandfathering is a huge\u00a0discount<\/a> on the actuarial premium. We&#8217;re not charging them for the actual risk of flooding; we&#8217;re charging them for the risk it was before we mapped the flood zone.&#8221; FEMA mapping decisions are also open to finagling by well-connected landowners. NBC News revealed in 2014 that FEMA revised its flood maps to give 95%+ <a href=\"https:\/\/www.nbcnews.com\/news\/investigations\/why-taxpayers-will-bail-out-rich-when-next-storm-hits-n25901\">discounted insurance premiums<\/a>\u00a0to \u201chundreds of oceanfront condo buildings and million-dollar homes,\u201d including properties on its \u201crepetitive loss list.\u201d<\/p>\n<p class=\"p-text\">FEMA, unlike private insurers, lacks incentives to acquire and analyze the complex data vital for setting rates for 5 million properties. The Government Accountability Office noted a few years ago that FEMA provided\u00a0&#8220;direction on file cabinet sizes and the use of candles in file rooms but did not provide clear <a href=\"http:\/\/www.gao.gov\/assets\/670\/662438.pdf\">direction on electronic recordkeeping<\/a>.&#8221;\u00a0GAO did not disclose whether the candle guidelines were derived from Charles Dickens\u2019 novels.<\/p>\n<p class=\"p-text\">Rep. <a href=\"https:\/\/affordablehousingcoalition.org\/2017\/05\/19\/financial-services-committee-releases-flood-insurance-reform-bill-summary\/\">Jeb Hensarling<\/a> (R-Tex.), chairman of the House Financial Services Committee, is pushing a bill that would curtail some subsidies and allow more competition from private insurers. A competing bill championed by Sen. Cory Booker (D-NJ) and Sen. <a href=\"https:\/\/www.rubio.senate.gov\/public\/index.cfm\/press-releases?ContentRecord_id=0C079923-7EAF-4763-A9F3-A2687631A182\">Marco Rubio<\/a> (R-FL) would perpetuate current perverse incentives and, as the New Jersey Star Ledger warned, would be \u201calmost certain to encourage more <a href=\"http:\/\/www.nj.com\/opinion\/index.ssf\/2017\/06\/in_long_run_bill_to_overhaul_flood_insurance_will.html\">building in repeatedly flooded areas<\/a> such as Mystic Island in Little Egg Harbor.\u201d<\/p>\n<p class=\"p-text\">Some Democrats have pushed for Congress <a href=\"https:\/\/democrats-financialservices.house.gov\/news\/documentsingle.aspx?DocumentID=399985\">to \u201cforgive\u201d NFIP\u2019s debt<\/a> \u2014\u00a0the usual D.C. boondoggle \u201cfix.\u201d But both the GAO and the Congressional Budget Office concluded that NFIP will <a href=\"https:\/\/www.cbo.gov\/system\/files\/115th-congress-2017-2018\/reports\/52638-nfipletter.pdf\">continue to be unsustainable<\/a> even if past losses are expunged. The program&#8217;s\u00a0<a href=\"https:\/\/www.nar.realtor\/news-releases\/2017\/03\/with-national-flood-insurance-program-expiring-in-six-months-realtors-sound-the-alarm\">third-highest ever claims<\/a> payout was\u00a0last year \u2014 despite the lack of a mega-disaster such as Hurricane Katrina or Hurricane Sandy. Hurricane Harvey will add billions of dollars to NFIP\u2019s debt (almost a <a href=\"https:\/\/www.cnbc.com\/2017\/08\/30\/flood-insurance-policies-plunge-in-houston.html\">quarter million homes<\/a> in Harris County alone have flood insurance).<\/p>\n<p class=\"p-text\">The financial soundness of federal flood insurance will always depend on politicians\u2019 self-restraint in buying votes. In other words, the program is actuarially doomed. There is no constitutional right to federal bailouts for flooded homes.
