Comey’s book tour is all about ‘truth’ \u2014 but his FBI tenure, not so much<\/a><\/h2>\n

In his ABC interview last Sunday, former FBI chief James Comey<\/a><\/span>\u00a0boasted endlessly<\/a> of his devotion to truth, which he said \u201chas to be central to our lives<\/a>.\u201d Touting his role in bringing down Martha Stewart, he declared, \u201cThe truth matters in the criminal justice system.\u201d But, when he was FBI boss from 2013 to 2017, his agency duped the American public whenever convenient.<\/p>\n

\u00a0In 2014, Comey declared<\/a> that \u201cWe do use deception at times to catch crooks, but we are acting responsibly and legally.\u201d His comment was spurred\u00a0by revelations that an FBI agent had masqueraded as an Associated Press reporter<\/a>\u00a0and fabricated an AP story. The Associated Press complained that the FBI\u2019s tactics undermined \u201cthe vital distinction between the government and the press,” while the Reporters Committee for Freedom of the Press protested that the ruse \u201ccreates the appearance that it is not independent of the government<\/a>.\u201d But Comey declared the technique was \u201cproper and appropriate<\/a>,\u201d allowing such scams to continue.<\/div>\n

The AP charade was chump change compared to the FBI\u2019s next media flim-flam. After a\u00a0high-profile confrontation<\/a> between federal agents and Nevadan ranchers in 2014, the FBI\u00a0created a bogus independent film crew<\/a> that spent almost a year hounding the Cliven Bundy family and their supporters, taping their comments to propel federal charges against them. The feds eventually arrested and prosecuted Bundy family members.<\/p>\n

This past January, federal judge Gloria Navarro dismissed all charges,\u00a0denouncing \u201cflagrant\u201d and \u201creckless\u201d<\/a>\u00a0misconduct by federal prosecutors. The FBI was exposed for\u00a0lying for more than three years <\/a>regarding its deployment of sniper teams\u00a0around the Bundys\u2019 ranch prior to the Bundys summoning supporters to protect them.<\/p>\n

The Justice Department inspector general last month exposed Comey\u2019s arguably\u00a0deceitful tactics regarding\u00a0his campaign to outlaw private encryption<\/a>, which he perennially portrayed as a grave peril to public safety. After a Muslim\u00a0couple\u00a0gunned down 14 people in San Bernardino, Calif., the\u00a0FBI invoked a 1789 law to sway a federal judge<\/a>\u00a0to order Apple to write anti-encryption software that would\u00a0hand the FBI the keys to break into the terrorist\u2019s iPhone (and all other iPhones<\/a>).<\/p>\n

While Apple appealed that decision, Comey testified to Congress in March 2016 that the\u00a0FBI was effectively helpless unless Apple was brought to heel<\/a>. But three weeks later, the Justice Department announced that a private vendor had opened the killer\u2019s iPhone\u2019s records for the FBI. The IG report concluded that Comey \u201cdidn\u2019t know that his testimony was false at the time he gave it<\/a>,\u201d the Electronic Freedom Foundation noted.<\/p>\n

In his ABC interview, Comey recited his devotion to transparency \u2014 but that was often a scarce commodity when he was FBI chief. On the day after Omar Mateen killed 49 people at the Orlando Pulse nightclub in June 2016, Comey promised: \u201cWe will leave no stone unturned and we<\/a>\u00a0will work all day and all night to understand the path to that terrible night. \u2026 we\u2019ll look at it in an open and honest way, and be transparent about it.\u201d But Comey provided zero transparency over the following 11 months prior to President Trump<\/a><\/span>\u2019s firing him last May. The FBI even\u00a0redacted the killer\u2019s endorsement of ISIS in the initial transcripts<\/a>\u00a0they released of his discussions with hostage negotiators on the night of the shooting.<\/p>\n

In his post-carnage comments, Comey complained of the difficulty of investigating lone wolf terrorists like Mateen: \u201cWe are looking for needles in a nationwide haystack<\/a>.\u201d But the FBI never admitted until recently that the killer\u2019s Afghan father \u2014\u00a0who hosted an anti-U.S. talk show<\/a>\u00a0\u2014 had\u00a0been an FBI informant<\/a> since 2005.<\/p>\n

Thanks in part to other Comey policies, the Justice Department suffered a stunning defeat in the biggest terrorism trial since 9\/11. The feds charged Noor Salman, Omar Mateen\u2019s widow, with material support of a foreign terrorist organization and lying to the FBI about knowing about her husband\u2019s plan to attack on the nightclub. After the FBI\u00a0interrogated her for 18 hours<\/a>\u00a0without a lawyer present, Salman signed a statement<\/a> composed by an FBI agent. But her supposed confession\u00a0had numerous falsehoods<\/a> (added to bolster the prosecution) that torpedoed the government\u2019s case.<\/p>\n

After the verdict was announced, the jury foreman declared: \u201cI wish that the\u00a0FBI had recorded their interviews with Ms. Salman as there were several<\/a>\u00a0significant inconsistencies with the written summaries of her statements.\u201d FBI agents, unlike many local and state police departments, have\u00a0long refused to record interrogations<\/a> or suspects\u2019 confessions, instead maximizing their own power by writing up expo facto memos (known as Form 302) that are presented\u00a0in court as the gospel truth.<\/p>\n

In 2014, Attorney General Eric Holder<\/a><\/span>\u00a0ordered the FBI and other federal law enforcement agencies<\/a> to record interviews with suspects. But Comey\u00a0allowed the FBI to scorn Holder\u2019s mandate<\/a>. Comey\u2019s stonewalling on this issue helped destroy the credibility of the FBI\u2019s investigation<\/a> into Hillary Clinton<\/a><\/span>\u2019s email shenanigans.<\/p>\n

When\u00a0FBI agents interviewed Clinton in July 2016, there was no recording and no transcript<\/a>. Relying on 302 memos instead of tapes gave FBI officials unlimited sway over what the American people would be told about the interview \u2014 and the rest of the investigation. In September 2016, shortly after the FBI publicly released the purported 302 on the Clinton interview, Peter Strzok, the\u00a0lead FBI investigator for the Clinton emails<\/a>\u00a0and one of the agents who interviewed her, texted his mistress, FBI lawyer Lisa Page: \u201cThere are VERY inflammatory things<\/a> in the 302s we didn’t turn over to Congress … that are going to come out in FOIA and absolutely inflame Congress.\u201d<\/p>\n

Strzok was eventually evicted from Special Counsel Robert Mueller<\/a><\/span>\u2019s investigation because of his intense anti-Trump bias <\/a>but this particular fiasco would not have occurred if Comey had heeded Holder\u2019s directive.<\/p>\n

In his ABC interview, Comey described himself as the \u201cguardian\u201d of the FBI\u2019s role \u201cas an independent force in American life<\/a>.\u201d The lies and abuses that proliferated during Comey\u2019s reign as FBI director are a reminder why the Founding Fathers never intended for a federal police force to become \u201can independent force\u201d akin to the Senate or Supreme Court. Comey helped sway millions of Americans to distrust the FBI \u2014 which, in the long run, may be his only positive political legacy.<\/p>\n
