The Government: Liability for Thee But Not for Me<\/a><\/h1>\n

Why are those who work for the state never held accountable for the damage they inflict?<\/h2>\n

Few Americans recognize the Yukon-sized legal rights void in their daily lives. I was recently reminded of this hard fact after encountering what appeared to be an anti-tank spike left over from the battle of Stalingrad in a government parking lot. Unfortunately, government\u2019s promise to serve also routinely conveys a license to harm.<\/div>\n<\/div>\n

Heading for a hike along the Potomac River, I pulled my car into a spot in an unpaved, uneven Fairfax County Park Authority lot at Difficult Run Stream<\/a>. I nudged forward and stopped before my wheels tapped the concrete block at the end of the spot. The front of my car extends 20 inches beyond my wheel and I was chagrined to hear something tearing into the underside of my Ford Contour<\/a>. I stepped out of the car and saw that the concrete parking barrier was topped by an unmarked five-inch steel rebar that had ripped through my plastic bumper, tore loose my power steering hose, and doused the block with liquids from my engine. Most of the nearby concrete bars had no such spurs but Fairfax County apparently missed this one.<\/p>\n

Ever the optimist, I filed a claim with Fairfax County for the $129 power steering hose repair (the towing was \u201cfree\u201d thanks to GEICO and that bumper was already ugly before the gash). Seven weeks later, Fairfax County notified me that \u201cyou failed to pay full time and attention to a stationary object resulting in the proximate cause of this loss and contributing to you [sic] own damages.\u201d Apparently, since a Fairfax County employee did not willfully target my power steering hose, the government had no liability.<\/p>\n

The letter cited a\u00a01947 Virginia court case<\/a> that purportedly exonerated Fairfax County. I read the decision seeking profound insights into malignant parking lots. Instead, it dealt with a drunk who was heaved out of a Norfolk movie theater. While sprawled on the sidewalk, he cast a \u201cvile insult\u201d towards a passing theater employee who punched him out. The court rejected the man\u2019s lawsuit for damages thanks to his \u201ccontributory negligence.<\/p>\n

<\/b>Admittedly, I did heartily cuss out that steel rebar. But I was puzzled by the lack of liability\u2014especially since the county had sent a crew to that parking lot to \u201chammer those rebars back in\u201d the same day that I\u2019d initially complained, according to the assurances of a safety analyst. I emailed the county press office inquiring as to whether the county had ever compensated anyone for steel rebar damage and received a blizzard of legalese in response. No matter how high the rebar protrudes, it is apparently \u201cclose enough for government work.\u201d<\/p>\n

I posted the spike photos on Facebook and a small business owner responded: \u201cYou\u2019re lucky the county did not try to charge you for a hazmat clean up the hydraulic fluid you dumped on their property.\u201d A Pentagon scientist quipped: \u201cIf you parked one foot from the spike, you probably would have gotten a ticket for parking outside the space.\u201d Another commenter, paraphrasing a venerable legal principle, nailed the issue: \u201cIgnorance of the spike is no excuse.\u201d<\/p>\n

If the government decides to provide a service, it is rarely liable for any damages it inflicts. Virginians will be hugely inconvenienced next year when Washington, D.C.\u2019s public transportation system, Metro,\u00a0shuts down subway lines beyond Reagan National Airport for 98 days straight<\/a>. But because Metro is shielded by sovereign immunity<\/a>, victims are entitled to nothing except endless replays of Metro\u2019s \u201cwe regret the inconvenience\u201d announcement.<\/p>\n

Public schools are perhaps the largest \u201cno fault\u201d government service. A federal judge recently rejected a lawsuit claiming that utterly dysfunctional schools in Detroit had violated\u00a0children\u2019s \u201cright to literacy.\u201d<\/a>\u00a0No matter how much parents are forced to pay in taxes for schools, \u201cno plaintiff to date has been able to convince a court that a school owes him or her any more than<\/a> \u2018a chair in a classroom,\u2019\u201d as law professor Judith Berliner Cohen wrote. Joining the PTA is a paltry substitute for a legally enforceable claim to decent schooling.<\/p>\n

The same principle of unaccountable government poses deadly perils. Police shot and killed almost a thousand people<\/a> last year, and Supreme Court rulings provide broad immunity for police who<\/a> open fire. High speed police chases have killed more than 5,000 innocent bystanders and passengers<\/a> and injured more than a quarter million people since 1979. Yet the victims and<\/a> next of kin are routinely out of luck when seeking damages.<\/a><\/p>\n

Exempting government agencies from liability minimizes their incentives to curtail harm from wayward spikes, failing schools, police with itchy trigger fingers, and many other perils. In the name of \u201ctruth in public services,\u201d perhaps government facilities should post warning signs: \u201cAbandon Almost All Hope of Liability Ye Who Enter!\u201d<\/a><\/p>\n
