Don’t count on the FBI to clear up the Kavanaugh-Ford mess. Its record is flawed.<\/a><\/h2>\n

After last week\u2019s explosive congressional hearing, the Senate and the Trump administration agreed to reopen the\u00a0FBI background check into Supreme Court nominee Brett Kavanaugh.\u00a0Former FBI chief James Comey wrote Sunday that \u201cthe F.B.I. is up for this\u201d because it is \u201cfull\u201d\u00a0of “people who just want to figure out what\u2019s true<\/a>.”<\/p>\n

But truth has often been a scarce commodity in FBI investigations. Consider these cases stretching back decades:<\/p>\n

\u25ba\u00a0The chief of the FBI\u2019s violent crimes section was sent to\u00a0prison<\/a> in 1997 for destroying a report\u00a0criticizing FBI conduct in a 1992 showdown at Ruby Ridge, Idaho.\u00a0A federal judge lambasted<\/a> the FBI and Justice\u00a0Department for misleading testimony and\u00a0withholding key evidence in that landmark case.<\/p>\n

\u25ba\u00a0When a 1993 FBI tank assault against the Branch Davidians in Waco, Texas, ended in an inferno, FBI officials emphatically denied that they had any link to the fire. After it was\u00a0revealed six years later that the FBI tanks had fired pyrotechnic devices<\/a>\u00a0during the assault,\u00a0Attorney General Janet Reno\u00a0sent U.S. Marshals<\/a> to seize Waco-related evidence at FBI headquarters.<\/p>\n

A history of FBI screw-ups\u00a0and bias<\/h3>\n

\u25ba Solid investigations by FBI agents can vanish.\u00a0A few days after the 9\/11 attacks, FBI chief Robert Mueller declared that\u00a0there were \u201cno warning signs<\/a>\u201d of\u00a0suspicious Arabs receiving pilot training in the U.S. \u2014\u00a0despite pre-9\/11 reports by FBI agents in Phoenix<\/a> and Minneapolis<\/a>. Though the FBI is often venerated nowadays, a 2002 congressional report concluded that FBI incompetence and negligence helped make the U.S. \u201ca sanctuary for radical terrorists<\/a>.\u201d<\/p>\n

\u25ba After the worst terrorism attack since 9\/11<\/a> left 49 people dead at the Orlando Pulse Nightclub<\/a>, FBI chief Comey promised in 2016 to\u00a0“leave no stone unturned<\/a>” and to work\u00a0“in an open and honest way, and be transparent about it.” But the federal case against the killer’s widow collapsed in March after jurors belatedly learned that the killer’s\u00a0father was anFBI informant<\/a> and that there was a key falsehood<\/a>\u00a0in the confession produced by the FBI.<\/p>\n

\u25ba Last January,\u00a0federal judge Gloria Navarro slammed\u00a0the FBI and Justice Department for withholding important\u00a0evidence in the Bundy Ranch case (including the deployment of FBI snipers around the Bundy\u00a0property), leading her to dismiss all federal charges<\/a>.<\/p>\n

\u25ba In June, an Inspector General report <\/a>revealed that the FBI\u00a0gave deference (including disregarding false statements)\u00a0to Hillary Clinton aides during the investigation of her email server.\u00a0The FBI delayed speaking to Clinton until the end of the investigation and planned to absolve her \u201cabsent a confession from Clinton.\u201d\u00a0This Looney Tunes standard for resolving the controversy may have been partly the result of visceral\u00a0anti-Trump bias<\/a>\u00a0by some FBI officials handling the probe.<\/p>\n

The FBI has perennially exaggerated the quality of its evidence, almost always to the benefit of prosecutors. A 1997 Inspector General\u00a0report found that FBI lab experts provided court testimony\u00a0“that appeared\u00a0tailored to the most\u00a0incriminating result” involving “speculation\u00a0 beyond [their] scientific expertise<\/a>.\u201d A 2004 National Academy of Sciences report concluded that decades of FBI court testimony matching bullets to specific firearms in thousands of homicide cases was \u201cunreliable<\/a>\u201d and \u201cmisleading under federal rules of evidence.”<\/p>\n

The Washington Post\u00a0reported in 2015 that flawed FBI trial testimony may have helped sentence\u00a032 people<\/a> to death. And the FBI helped convict a teenager for murder based on a DNA hair match; the defendant was released from prison\u00a028 years later after a re-examination showed\u00a0it was the hair of a dog<\/a>.<\/p>\n

FBI won’t be voice of God on\u00a0Kavanaugh<\/h3>\n

Despite past pratfalls, FBI agents may be able to take the Kavanaugh controversy slightly beyond its current \u201che said\/she said\u201d and \u201csomebody heard something\u201d level. Exposing contradictions between witnesses and charges could smite a few of the many doubts permeating this case.\u00a0But it would be naive to view an\u00a0FBI executive summary of a stack of memos recapping FBI interviews as the voice of God.<\/p>\n

Americans should blame bipartisan shenanigans for this FBI rush job.\u00a0The Trump White House wrongfully withheld from the\u00a0Senate thousands of pages<\/a> of Kavanaugh\u2019s records\u00a0from the Bush White House, while Sen. Dianne Feinstein’s office\u00a0may have leaked Christine Blasey Ford\u2019s allegation<\/a> just\u00a0before the Senate vote on the nomination. Such chicanery almost assures greater disdain for the Senate and the Supreme Court, regardless of the outcome of the Kavanaugh brouhaha.<\/p>\n
