The FBI even helped send innocent men to prison for life to safeguard Bulger.<\/p>\n<p>When this scandal began unraveled, the Bush administration rushed to assert &#8220;executive privilege&#8221; in 2001 to protect the reputation of the FBI and Justice Department.\u00a0 More details of FBI scandalous behavior eventually leaked out, especially during Bulger&#8217;s a dozen years later.\u00a0 A federal judge aptly labeled the case &#8220;<a href=\"https:\/\/www.nytimes.com\/2011\/10\/24\/opinion\/the-stain-of-the-bulger-case.html\">official uncontrolled wickedness<\/a>.&#8221; A former FBI agent &#8220;was convicted of second-degree murder for leaking information to Boston mobsters that led to the 1982 shooting death of a gambling executive who also had ties to gangsters.&#8221;<\/p>\n<p>How many murderers is the FBI currently protecting?\u00a0 The FBI officially<a href=\"https:\/\/www.usatoday.com\/story\/news\/nation\/2013\/08\/04\/fbi-informant-crimes-report\/2613305\/\"> pre-approves its informants committing more than 5000 crimes per yea<\/a>r. What could possibly go wrong?<\/p>\n<p>Here&#8217;s an excerpt from my 2004 book, <a href=\"https:\/\/www.amazon.com\/gp\/product\/B00TDQ1TM0\/ref=dbs_a_def_rwt_bibl_vppi_i7\">The Bush Betraya<\/a>l, on the contortions that the Bush administration used to cover up FBI crimes:<\/p>\n<p><a href=\"http:\/\/jimbovard.com\/blog\/wp-content\/uploads\/2013\/03\/bush_betrayal.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft wp-image-4508 size-full\" src=\"http:\/\/jimbovard.com\/blog\/wp-content\/uploads\/2013\/03\/bush_betrayal.jpg\" alt=\"\" width=\"317\" height=\"475\" srcset=\"https:\/\/jimbovard.com\/blog\/wp-content\/uploads\/2013\/03\/bush_betrayal.jpg 317w, https:\/\/jimbovard.com\/blog\/wp-content\/uploads\/2013\/03\/bush_betrayal-100x150.jpg 100w\" sizes=\"auto, (max-width: 317px) 100vw, 317px\" \/><\/a>PRIVILEGED TO CONCEAL; OR HOW BUSH PROTECTS LIBERTY<br \/>\nOn December 12, 2001, Bush announced that he was invoking \u201cexecutive<br \/>\nprivilege\u201d to withhold subpoenaed documents from Congress because their<br \/>\ndisclosure would be \u201ccontrary to the national interest.\u201d Bush warned that the<br \/>\ncongressional investigation threatened Americans\u2019 cherished freedoms: \u201cThe<br \/>\nFounders\u2019 fundamental purpose in establishing the separation of powers in<br \/>\nthe Constitution was to protect individual liberty. Congressional pressure on<br \/>\nexecutive branch prosecutorial decisionmaking is inconsistent with separation<br \/>\nof powers and threatens individual liberty.\u201d3<\/p>\n<p>Bush invoked protecting individual liberty to cover up the FBI\u2019s role in<br \/>\nmass murder in Boston and its perversion of justice throughout New England.<br \/>\nBeginning in 1965, the FBI enrolled Boston mob murderers as informants<br \/>\nand shielded these killers time and again from prosecutors seeking to nail<br \/>\nthem. The FBI helped send four innocent men to prison for life for a murder<br \/>\ncommitted by one of the FBI\u2019s favorites. (Two of the men died in prison.) The<br \/>\nFBI\u2019s prize informant, \u201cWhitey\u201d Bulger, absconded in 1995 and was quickly<br \/>\nplaced on the \u201cTen Most Wanted\u201d list, thanks to his connection to more than<br \/>\n20 murders.<\/p>\n<p>Bush\u2019s invocation of executive privilege enraged Rep. Dan Burton (R-Ind.),<br \/>\nchairman of the House Government Reform Committee, who was leading<br \/>\nthe investigation into FBI perfidy. When a deputy assistant attorney<br \/>\ngeneral appeared before the committee the day after Bush\u2019s statement, Burton<br \/>\nblasted the guy: \u201cThis is not a monarchy. . . . We\u2019ve got a dictatorial President.<br \/>\n. . . Your guy\u2019s acting like he\u2019s king.\u201d4<\/p>\n<p>Burton notified Attorney General Ashcroft that \u201cit eludes me how it is in<br \/>\nthe national interest to cloak this dark chapter of the Justice Department\u2019s history<br \/>\nin secrecy.\u201d5 He later summarized the outrages: \u201cThe United States Department<br \/>\nof Justice allowed lying witnesses to send men to death row. It stood<br \/>\nby idly while innocent men spent decades behind bars. It permitted informants<br \/>\nto commit murder. It tipped off killers so that they could flee before they<br \/>\nwere caught. . . . And then, when people went to the Justice Department with<br \/>\nevidence about murders, some of them ended up dead.\u201d6<\/p>\n<p>The House Government Reform Committee\u2019s final report on its investigation,<br \/>\nreleased in November 2003, denounced the FBI\u2019s conduct in New England<br \/>\nas \u201cone of the greatest failures in the history of federal law enforcement.\u201d<br \/>\nMore than 20 murders were allegedly committed by FBI informants and<br \/>\n\u201cmajor homicide and criminal investigations in a number of states including<br \/>\nMassachusetts, Connecticut, Oklahoma, California, Nevada, Florida and<br \/>\nRhode Island were frustrated or compromised by federal law enforcement of-<br \/>\nficials intent on protecting informants.\u201d Countenancing murders by FBI informants<br \/>\nwas not a rogue Boston operation; instead, awareness of the killings<br \/>\nextended \u201call the way up to the office of FBI chief J. Edgar Hoover.\u201d The<br \/>\ncommittee also raised questions about \u201cwhether the FBI used its authority to<br \/>\nprotect former Massachusetts State Senate President William Bulger [the<br \/>\nbrother of \u2018Whitey\u2019 Bulger] from scrutiny by law enforcement or to advance<br \/>\nhis political career.\u201d7<\/p>\n<p>The FBI office in Boston was continuing to deny any misconduct as late<br \/>\nas 2001\u2014shortly before Bush invoked executive privilege. Though two of the<br \/>\nfour people wrongfully sent to prison for life because of the FBI were still alive,<br \/>\nthe Justice Department treated this as an irrelevant closed case.<\/p>\n<p>The Bush administration eventually dropped its claims of executive privilege<br \/>\nand provided foot-dragging cooperation. The committee noted that \u201cthe<br \/>\nPresident\u2019s claim of executive privilege was a drastic departure from the longstanding history of Congressional access to precisely the types of documents<br \/>\nsought by the Committee.\u201d Congress had routinely had access to such documents<br \/>\ngoing back to the Teapot Dome scandal of 1923.<\/p>\n<p>No FBI agent was ever disciplined, let alone fired, for his role in fomenting<br \/>\nand condoning mass murder in Boston. After the committee issued its report<br \/>\nin November 2003, the FBI issued a statement: \u201cWhile the FBI recognizes there have been instances of misconduct by a few FBI employees, it also recognizes the importance of human source information in terrorism, criminal and counterintelligence investigations.\u201d8 The FBI did not specify how many murders it would countenance in the future by its informants.<\/p>\n<p>The administration had tactical reasons to stonewall Burton\u2019s investigation.<br \/>\nThe Hill, a Capitol Hill newspaper, noted that even relatively ancient<br \/>\n\u201crevelations [of FBI misconduct] would be problematic for Ashcroft at a time<br \/>\nwhen he is pushing to significantly expand the powers of law enforcement as<br \/>\npart of the war on terrorism.\u201d9 In a May 2002 announcement that he was unleashing<br \/>\nFBI agents to conduct surveillance in any \u201cpublic\u201d place they choose<br \/>\n(including churches, mosques, and political meetings), Ashcroft boasted: \u201cIn<br \/>\nits 94-year history, the Federal Bureau of Investigation has been . . . the tireless<br \/>\nprotector of civil rights and civil liberties for all Americans.\u201d10 At the time<br \/>\nof Ashcroft\u2019s declaration, the Justice Department was still using trick after trick<br \/>\nto block congressional discoveries of FBI atrocities. And in its response to the<br \/>\nBurton investigation, the Bush administration did not hesitate to invoke the<br \/>\nhighest principles to cover up dastardly deeds.
