But there is another realm where far too much has been presumed because of often token gestures. Political consent is defined radically differently than the consent that people freely give in their daily lives.<\/p>\n<\/div>\n<div class=\"body-content clearfix\">\n<p>The Declaration of Independence enshrined the notion that government must possess \u201cthe consent of the governed.\u201d Unfortunately, winning politicians often claim blank checks to define the hidden meaning behind citizens\u2019 ballots. \u201cConsenting\u201d on Election Day is portrayed as pre-approving anything politicians dictate in the following years.<\/p>\n<p>Regardless if your candidate campaigned on a peace platform, you \u201cconsented\u201d to any <a href=\"https:\/\/www.nbcnews.com\/news\/world\/u-s-bombed-iraq-syria-pakistan-afghanistan-libya-yemen-somalia-n704636\" target=\"_blank\" rel=\"noopener noreferrer\"> wars he might subsequently start or support <\/a> . Regardless if your candidate <a href=\"https:\/\/www.huffingtonpost.com\/scott-morgan\/obama-medical-marijuana_b_857852.html\" target=\"_blank\" rel=\"noopener noreferrer\"> promised to end federal crackdowns on marijuana <\/a> , you \u201cconsented\u201d to the Drug Enforcement Administration\u2019s raids on medical cannibis cooperatives. Regardless if your candidate promised to end deficit spending, you \u201cconsented\u201d to trillions of dollars of additional federal debt. Regardless if your candidate promised transparency and honesty, you consented to the government keeping millions of secrets and shrouding its worst abuses.<\/p>\n<p>Government agencies structure their policies to make even more absurd presumptions of \u201cconsent\u201d in daily life.<\/p>\n<p>Because you traveled abroad, you supposedly consented to Department of Homeland Security <a href=\"https:\/\/www.nytimes.com\/2018\/01\/05\/us\/politics\/trump-border-search-cellphone-computer.html\" target=\"_blank\" rel=\"noopener noreferrer\"> agents examining and copying <\/a> all the records on your cell phone or computer when you return to the United States. The American Civil Liberties Union and other groups are fighting this policy in federal court but <a href=\"https:\/\/www.nytimes.com\/2017\/02\/14\/business\/border-enforcement-airport-phones.html\" target=\"_blank\" rel=\"noopener noreferrer\"> this Obama-era policy <\/a> remains the law of the land.<\/p>\n<p>Because you bought an airline ticket, you supposedly consented to being pawed by a Transportation Security Administration agent, including an \u201cenhanced patdown\u201d that often includes <a href=\"https:\/\/www.usatoday.com\/story\/opinion\/2018\/10\/15\/christine-blasey-ford-test-tsa-victims-sexual-assault-patdown-column\/1601134002\/\" target=\"_blank\" rel=\"noopener noreferrer\"> vigorously groping Americans\u2019 groins <\/a> (regardless of <a href=\"https:\/\/www.yahoo.com\/gma\/tsa-fails-most-tests-latest-undercover-operation-us-215605174--abc-news-topstories.html\" target=\"_blank\" rel=\"noopener noreferrer\"> TSA\u2019s incompetence <\/a> at discovering actual threats).<\/p>\n<p>Because you chose to use <a href=\"https:\/\/www.gsnmagazine.com\/node\/22223?c=infrastructure_protection\" target=\"_blank\" rel=\"noopener noreferrer\"> the Washington <\/a> or New York subway, you have consented to a <a href=\"https:\/\/ggwash.org\/view\/31498\/metro-bag-searches-arent-always-optional\" target=\"_blank\" rel=\"noopener noreferrer\"> warrantless search of your backpack or purse <\/a> by local police who receive a federal grant to conduct security theater performances.<\/p>\n<p>Because you drive on government roads, you supposedly consented to <a href=\"https:\/\/www.eff.org\/deeplinks\/2016\/01\/no-cost-license-plate-readers-are-turning-texas-police-mobile-debt-collectors-and\" target=\"_blank\" rel=\"noopener noreferrer\"> federally-funded license plate scanners <\/a> compiling a dossier of when and where you travel. And for anyone who <a href=\"https:\/\/www.wired.com\/2015\/05\/even-fbi-privacy-concerns-license-plate-readers\/\" target=\"_blank\" rel=\"noopener noreferrer\"> objects to federal, <\/a> state, and local agencies tracking them at almost all times (including when <a href=\"https:\/\/www.foxnews.com\/us\/feds-enlist-police-to-scan-gun-show-customers-license-plates-report-finds\" target=\"_blank\" rel=\"noopener noreferrer\"> they visit gun shows <\/a> ), remember that \u201cthose who have nothing to hide have nothing to fear.\u201d<\/p>\n<p>Presumed consent entitles government to do as politicians please. Because Americans \u201cconsented\u201d to George W. Bush and Barack Obama\u2019s presidential candidacies, their appointees authorized the National Security Administration to <a href=\"https:\/\/www.pclob.gov\/library\/215-Report_on_the_Telephone_Records_Program.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"> create massive databases compiling details on all the phone calls they made or received. <\/a> In millions of cases, <a href=\"https:\/\/mashable.com\/2014\/06\/05\/edward-snowden-revelations\/#TP42ItquQPqt\" target=\"_blank\" rel=\"noopener noreferrer\"> NSA also vacuumed up Americans\u2019 emails and web browsing history <\/a> . Even though presidents denied they were illegally spying on Americans, voters still presumably \u201cconsented.\u201d Americans may be shocked in the coming months and years to learn of illegalities they purportedly \u201cconsented\u201d to when Trump was elected.<\/p>\n<p>Political consent is defined these days as rape was defined a generation or two ago: people consent to anything which they do not forcibly resist. Anyone who does not stone city hall presumably consented to everything the mayor does. Anyone who does not jump the White House fence and try to storm into the Oval Office consents to all executive orders. Anyone who doesn&#8217;t assail the nearest federal office building consents to the latest edicts in the <em>Federal Register.<\/em> And if people do attack government facilities, then they are terrorists who can be justifiably killed or imprisoned forever.<\/p>\n<p>Ironically, the Founding Fathers proffered a notion of political consent much closer to what #MeToo activists are championing nowadays. The Bill of Rights provided bright lines which politicians were prohibited from crossing regardless of vote counts. The Bill of Rights was a sacred pledge that politicians admitted they had no right to censor the press, confiscate private firearms, suppress religion, or inflict cruel and unusual punishment on citizens. The fact that politicians routinely often violate Americans\u2019 constitutional rights does not make the Bill of Rights any less binding.<\/p>\n<p>Regardless of the outcome of the midterm congressional elections, we should remember that <a href=\"https:\/\/history.house.gov\/Institution\/Origins-Development\/Oath-of-Office\/\" target=\"_blank\" rel=\"noopener noreferrer\"> members of Congress <\/a> and <a href=\"http:\/\/americanhistory.si.edu\/presidency\/1b2.html\" target=\"_blank\" rel=\"noopener noreferrer\"> the president <\/a> took oaths promising to honor and defend the Constitution. In the same way that consenting to a dinner date does not entitle someone to bind and beat another person, consenting in a voting booth does not entitle politicians to ravage Americans\u2019 rights.
