All it does is protect the interests of the federal government and business.<\/h3>\n<\/div>\n<\/div>\n<p class=\"speakable-p-1 p-text\">This week the <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2019\/06\/24\/freedom-information-act-supreme-court-rules-south-dakota-case\/1475089001\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-track-label=\"inline|intext|n\/a\">Supreme Court\u00a0ruled<\/a>\u00a0that the federal government can keep secret the food stamp sales totals of grocery stores.\u00a0By a 6-3 vote, <a href=\"https:\/\/www.supremecourt.gov\/opinions\/18pdf\/18-481_5426.pdf\" target=\"_blank\" rel=\"noopener noreferrer\" data-track-label=\"inline|intext|n\/a\">the court decided<\/a>\u00a0that such business records are exempt from disclosure under the federal <a href=\"https:\/\/www.usatoday.com\/story\/opinion\/2018\/06\/15\/inspector-general-report-clinton-emails-secrecy-column\/704890002\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-track-label=\"inline|intext|n\/a\">Freedom of Information Act <\/a>(FOIA). This case, started eight\u00a0years ago by the\u00a0Argus Leader\u00a0(a member of the\u00a0USA Today\u00a0network), is another landmark in cloaking federal data from the American people.<\/p>\n<p class=\"speakable-p-2 p-text\">The court upheld retail sales data secrecy despite no evidence that such disclosures would harm anyone.\u00a0Argus Leader\u00a0news editor Cory Myers\u00a0labeled the decision \u201ca massive blow to the public\u2019s right to know how its tax dollars are being spent, and who is benefiting.&#8221;<\/p>\n<p class=\"p-text\">Controversies over the food stamp program have multiplied as evidence accumulated\u00a0revealing that the program is a public health disaster. A <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC5237482\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-track-label=\"inline|intext|n\/a\">2017 study<\/a> published in\u00a0BMC Public Health\u00a0found that food stamp recipients were twice as likely to be obese as\u00a0eligible non-recipients.\u00a0This confirms a\u00a0<a href=\"https:\/\/fns-prod.azureedge.net\/sites\/default\/files\/ops\/NHANES-SNAP07-10.pdf\" target=\"_blank\" rel=\"noopener noreferrer\" data-track-label=\"inline|intext|n\/a\">2015 USDA report<\/a>\u00a0which revealed that food stamp recipients are more likely\u00a0to be obese than eligible non-recipients (40% vs. 32%). But the feds have consistently sought to limit public information on the program.<\/p>\n<p class=\"p-text\">Food stamp supporters and food retailers <a href=\"https:\/\/thefern.org\/2014\/04\/are-stores-making-bank-off-food-stamps\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-track-label=\"inline|intext|n\/a\">helped block<\/a> a <a href=\"https:\/\/www.congress.gov\/bill\/113th-congress\/house-bill\/1752\" target=\"_blank\" rel=\"noopener noreferrer\" data-track-label=\"inline|intext|n\/a\">2013\u00a0congressional proposal<\/a>\u00a0to disclose how recipients\u00a0actually spend food stamps.\u00a0A <a href=\"https:\/\/fns-prod.azureedge.net\/sites\/default\/files\/ops\/SNAPFoodsTypicallyPurchased.pdf\" target=\"_blank\" rel=\"noopener noreferrer\" data-track-label=\"inline|intext|n\/a\">limited survey by USDA<\/a> released in 2016 indicated that sugar sweetened beverages are the item recipients of food stamps spend the most money on.But opening up the sales data nationwide to reveal what people purchase across the nation would do far more to spur food stamp reform and cease subsidizing junk food.\u00a0<strong>\u200b\u200b\u200b\u200b\u200b\u200b<\/strong><\/p>\n<p class=\"p-text\">Justice Stephen Breyer&#8217;s dissent yesterday warned that the decision &#8220;will deprive the public of information for reasons no better than convenience, skittishness, or bureaucratic inertia.&#8221; The Supreme Court gave a kick to a disclosure law that had already lost most of its teeth.<\/p>\n<p class=\"p-text\">In October 2001,\u00a0Attorney General John\u00a0Ashcroft <a href=\"https:\/\/nsarchive2.gwu.edu\/NSAEBB\/NSAEBB84\/Ashcroft%20Memorandum.pdf\" target=\"_blank\" rel=\"noopener noreferrer\" data-track-label=\"inline|intext|n\/a\">assured federal agencies<\/a> that the Justice Department \u201cwill defend your decisions\u201d to deny FOIA requests on broader grounds than previously prevailed.\u00a0Judicial Watch <a href=\"https:\/\/www.washingtonpost.com\/archive\/politics\/2002\/03\/03\/bush-view-of-secrecy-is-stirring-frustration\/d4124b14-efc2-42b2-a8f0-c6208c94eaa7\/?utm_term=.e947a6f0acf5\" target=\"_blank\" rel=\"noopener noreferrer\" data-track-label=\"inline|intext|n\/a\">characterized the Bush administration&#8217;s FOIA attitude<\/a> as &#8220;arrogance throughout\u00a0\u2014\u00a0that the government is not to be questioned.&#8221;\u00a0The Bush administration <a href=\"http:\/\/www.tulanelink.com\/tulanelink\/signstatements_box.htm\" target=\"_blank\" rel=\"noopener noreferrer\" data-track-label=\"inline|intext|n\/a\">blocked disclosures<\/a> of\u00a0almost all Patriot Act abuses, and the <a href=\"https:\/\/www.aclu.org\/other\/statement-caroline-fredrickson-director-aclu-washington-legislative-office-freedom-information?redirect=cpredirect\/28361\" target=\"_blank\" rel=\"noopener noreferrer\" data-track-label=\"inline|intext|n\/a\">ACLU later complained<\/a> that \u201cresponses to FOIA requests\u00a0are hopelessly slow.\u201d<\/p>\n<p class=\"p-text\">&#8220;Hope and Change&#8221; arrived on President Barack Obama\u2019s second day in office, when he <a href=\"https:\/\/www.justice.gov\/oip\/blog\/foia-post-8\" target=\"_blank\" rel=\"noopener noreferrer\" data-track-label=\"inline|intext|n\/a\">called FOIA<\/a> \u201cthe most prominent\u00a0expression of a profound national commitment to\u00a0ensuring an open Government&#8221;\u00a0and <a href=\"https:\/\/obamawhitehouse.archives.gov\/realitycheck\/the-press-office\/freedom-information-act\" target=\"_blank\" rel=\"noopener noreferrer\" data-track-label=\"inline|intext|n\/a\">declared that FOIA<\/a>\u00a0\u201cshould be administered with\u00a0a clear presumption: In the face of doubt, openness prevails.\u201d<\/p>\n<p class=\"p-text\">Unless, of course, White House political appointees objected.\u00a0Three months after Obama took office, White House counsel Gregory Craig <a href=\"https:\/\/www.hsdl.org\/?abstract&amp;did=789831\" target=\"_blank\" rel=\"noopener noreferrer\" data-track-label=\"inline|intext|n\/a\">quietly notified<\/a> all federal agencies\u00a0that \u201call documents and records that implicate the White House in any way are said to have &#8216;White House equities&#8217;\u00a0and must receive an extra layer of review, not by agency FOIA experts, but by the White House itself.\u201d A\u00a02016 congressional report titled &#8220;FOIA is Broken&#8221;\u00a0noted. Anything that could tarnish the administration\u2019s image violated its \u201cequities.\u201d\u00a0<a href=\"https:\/\/www.washingtonpost.com\/blogs\/erik-wemple\/wp\/2015\/03\/18\/ap-obama-administration-sets-new-record-for-denying-records\/?utm_term=.c3e8def021bb\" target=\"_blank\" rel=\"noopener noreferrer\" data-track-label=\"inline|intext|n\/a\">Emails\u00a0by the staff<\/a> at the National Archives and Records Administration admitted: \u201cWe live in constant fear\u00a0of upsetting the WH (White House).\u201d Politico\u00a0<a href=\"https:\/\/www.politico.com\/blogs\/under-the-radar\/2016\/05\/watchdog-suit-obama-white-house-slowing-foia-process-223016\" target=\"_blank\" rel=\"noopener noreferrer\" data-track-label=\"inline|intext|n\/a\">noted\u00a0in 2016<\/a> that, in some cases, White House FOIA \u201creferrals have led to years of delay.&#8221;<\/p>\n<p class=\"p-text\">In 2011, Obama\u2019s Justice Department <a href=\"https:\/\/www.pogo.org\/analysis\/2011\/11\/did-your-foia-request-really-not-exist-or-is-that-just-what-doj-told-you\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-track-label=\"inline|intext|n\/a\">formally proposed<\/a>\u00a0to permit federal agencies to falsely claim that requested documents did not exist.\u00a0The\u00a0<a href=\"https:\/\/www.wired.com\/2011\/10\/feds-embrace-foia-lying\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-track-label=\"inline|intext|n\/a\">ACLU complained<\/a>\u00a0that the proposal perverted \u201ca law designed to provide public access to government information to be twisted to permit federal law enforcement agencies to\u00a0actively lie to the American people.\u201d<\/p>\n<p class=\"p-text\">That proposal was dropped\u00a0after a media backlash, but the Obama administration\u2019s other policies\u00a0undercut the law.\u00a0The previously cited 2016 congressional report on FOIA\u00a0noted that many journalists had abandoned \u201cthe FOIA request as a tool because delays and redactions made the request process wholly useless for reporting.\u201d The Pentagon responded to a request for a list of titles of its reports by offering a partial response if the journalist\u00a0promised to never file\u00a0another FOIA request.\u00a0The Drug Enforcement Agency effectively torpedoed a FOIA request regarding notorious Mexican drug lord \u201cEl Chapo\u201d by\u00a0charging $1.4 million\u00a0for the response.<\/p>\n<h3 class=\"presto-h3\">The Obama administration was no better than its predecessors<\/h3>\n<p class=\"p-text\">The Associated Press reported in 2015 that the Obama administration \u201cset a\u00a0record again for <a href=\"https:\/\/nypost.com\/2015\/03\/18\/white-house-sets-new-record-for-censoring-denying-access-to-files\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-track-label=\"inline|intext|n\/a\">censoring government\u00a0files<\/a> or outright denying access to them\u201d\u00a0under FOIA.\u00a0My own experience, stretching back 30 years,\u00a0is that federal agencies routinely presume that anyone who has publicly criticized their programs forfeits his rights under FOIA.<\/p>\n<p class=\"p-text\">We owe it to Hillary Clinton for finally obliterating FOIA\u2019s credibility. After she was appointed secretary of state,\u00a0Clinton effectively exempted herself from FOIA, setting up a <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/elections\/2016\/07\/05\/timeline-hillary-clinton-email-investigation\/86706098\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-track-label=\"inline|intext|n\/a\">private server<\/a> to handle her official email.\u00a0The State Department\u00a0<a href=\"https:\/\/www.washingtonexaminer.com\/state-ignored-17-foia-requests-for-clintons-emails-before-2014\" target=\"_blank\" rel=\"noopener noreferrer\" data-track-label=\"inline|intext|n\/a\">ignored 17 FOIA requests<\/a>\u00a0for her emails prior to 2014 and said it\u00a0<a href=\"https:\/\/thehill.com\/policy\/technology\/282434-state-dept-would-need-75-years-to-compile-clinton-emails\" target=\"_blank\" rel=\"noopener noreferrer\" data-track-label=\"inline|intext|n\/a\">needed 75 years<\/a>\u00a0to comply with a FOIA request for Hillary&#8217;s aides&#8217; emails.\u00a0The Federal Bureau of\u00a0Investigation <a href=\"https:\/\/www.usatoday.com\/story\/opinion\/2018\/06\/15\/inspector-general-report-clinton-emails-secrecy-column\/704890002\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-track-label=\"inline|intext|n\/a\">shrugged off<\/a>\u00a0Hillary\u2019s aides using a program called\u00a0BleachBit\u00a0to destroy <a href=\"https:\/\/abcnews.go.com\/Politics\/hillary-clinton-deleted-33000-emails-secretary-state\/story?id=42389308\" target=\"_blank\" rel=\"noopener noreferrer\" data-track-label=\"inline|intext|n\/a\">30,000 of her emails<\/a> under subpoena by a congressional committee.\u00a0Federal judge\u00a0Royce Lamberth\u00a0<a href=\"https:\/\/www.cnn.com\/2018\/12\/07\/politics\/clinton-emails-lamberth\/index.html\" target=\"_blank\" rel=\"noopener noreferrer\" data-track-label=\"inline|intext|n\/a\">labeled<\/a>\u00a0the Clinton email affair \u201cone of the gravest modern offenses to government transparency.\u201d<\/p>\n<p class=\"p-text\">FOIA is \u201c<a href=\"https:\/\/freedom.press\/news\/freedom-information-act-getting-worse-under-trump-administration\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-track-label=\"inline|intext|n\/a\">getting worse under Trump<\/a>,\u201d according to\u00a0the Freedom of the Press Foundation.\u00a0FOIA requestors received nothing or\u00a0censored files in <a href=\"https:\/\/apnews.com\/714791d91d7944e49a284a51fab65b85\" target=\"_blank\" rel=\"noopener noreferrer\" data-track-label=\"inline|intext|n\/a\">78% of cases<\/a>\u00a0in 2017, and stonewalling often seems encouraged from the Oval Office on down.<\/p>\n<p class=\"p-text\">Forty-one years ago, the Supreme Court declared that\u00a0FOIA\u2019s purpose is \u201cto\u00a0ensure an informed citizenry, vital to the functioning of a democratic society.\u201d\u00a0After the Supreme Court\u2019s\u00a0Argus Leader decision, perhaps the law should be retitled \u201cThe Freedom\u00a0from\u00a0Information Act.\u201d If democracy depends on transparency, and government transparency is an illusion, then what is American democracy nowadays?<\/p>\n<p id=\"article-body-p-last\" class=\"p-text p-text-last\"><em>James Bovard, author of &#8220;Attention Deficit Democracy,&#8221; is a member of USA TODAY\u2019s Board of Contributors.
