But trusting ballots to leash either Donald Trump or Joe Biden would be the ultimate triumph of hope over experience.<\/p>\n<p>The Voting Rights Act of 1965 is the most venerated federal law of the last 60 years. When he signed the law, President Lyndon Johnson <a href=\"https:\/\/www.presidency.ucsb.edu\/documents\/remarks-the-capitol-rotunda-the-signing-the-voting-rights-act\" target=\"_blank\" rel=\"noopener noreferrer\">declared<\/a>, \u201cThis right to vote is the basic right without which all others are meaningless. It gives people, people as individuals, control over their own destinies.\u201d Johnson and generations of subsequent politicians assured Americans that possessing a vote was practically the only protection they needed against oppression. But the Voting Rights Act has failed to prevent politicians from ravaging voters of every race, creed, and color.<\/p>\n<p>Early in 1965, before the Voting Rights Act passed Congress, Johnson <a href=\"https:\/\/psmag.com\/news\/here-are-lyndon-johnson-and-martin-luther-king-talking-over-the-voting-rights-act-61166\" target=\"_blank\" rel=\"noopener noreferrer\">declared<\/a> in a phone call to Martin Luther King Jr., \u201cI just don\u2019t see how anybody can say that a man can fight in Vietnam but he can\u2019t vote.\u201d But expanding voting rights did nothing to nullify Johnson\u2019s dictatorial power over draftees. Tens of thousands of conscripts died in an unpopular war that mushroomed because the president dispatched them to a pointless foreign conflict. Regardless of how many lies Johnson told about Vietnam, young Americans were still compelled to follow his orders to the death in the jungles and rice paddies.<\/p>\n<p>Johnson also <a href=\"https:\/\/www.presidency.ucsb.edu\/documents\/remarks-the-capitol-rotunda-the-signing-the-voting-rights-act\" target=\"_blank\" rel=\"noopener noreferrer\">proclaimed<\/a> that the Voting Rights Act grants \u201cevery American Negro his freedom to enter the mainstream of American life\u201d but the FBI never got that memo. For most of the last five years of King\u2019s life, he was \u201cthe target of an intensive campaign by the FBI to \u2018neutralize\u2019 him as an effective civil rights leader,\u201d according to a 1976 Senate <a href=\"https:\/\/www.intelligence.senate.gov\/sites\/default\/files\/94755_II.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">report<\/a>. King\u2019s home, office, and hotel rooms were frequently, illegally wiretapped by the FBI, seeking information to discredit King. The FBI even set up its own Klan organization that savagely <a href=\"https:\/\/fee.org\/articles\/federal-surveillance-the-threat-to-americans-security\/\" target=\"_blank\" rel=\"noopener noreferrer\">attacked<\/a> civil-rights protesters. In San Diego, the FBI instigated violence between black groups that helped spur several killings.<\/p>\n<p><strong>Voting rights expanded at the same time the federal government became far more oppressive.<\/strong> More blacks voting after 1965 did not prevent Congress from declaring a war on drugs and enacting laws that locked away legions of people for possessing politically incorrect substances. Thanks in part to crackdowns on narcotics, the incarceration rate of black high-school dropouts <a href=\"https:\/\/gps.ucsd.edu\/_files\/faculty\/hanson\/hanson_publication_immigration_men.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">increased almost sevenfold<\/a> between 1960 and 2000, according to a 2009 study by Harvard professor George Borjas and colleagues. Selma, Alabama Mayor George Evans <a href=\"https:\/\/www.npr.org\/2015\/03\/08\/391619526\/selma-mayor-an-awesome-time-for-our-city\" target=\"_blank\" rel=\"noopener noreferrer\">told<\/a> National Public Radio in 2015: \u201cEven though we\u2019ve gained so much through voting rights and Bloody Sunday, we\u2019ve stepped backwards when it comes to crime and drugs and the jail system\u2014things like that.\u201d America\u2019s sad trajectory was <a href=\"https:\/\/www.salon.com\/2000\/11\/14\/haggard_3\/\" target=\"_blank\" rel=\"noopener noreferrer\">captured<\/a> 20 years ago by country singer Merle Haggard: \u201cIn 1960, when I came out of prison as an ex-convict, I had more freedom under parolee supervision than there\u2019s available to an average citizen in America right now \u2026 God almighty, what have we done to each other?\u201d<\/p>\n<p>Democratic presidential candidate Joe Biden <a href=\"https:\/\/www.wfxg.com\/story\/42464451\/joe-biden-releases-statement-on-55th-anniversary-of-voting-rights-act\" target=\"_blank\" rel=\"noopener noreferrer\">declared<\/a> in August, \u201cThe battle for the soul for America has many fronts; the right to vote is the most fundamental.\u201d But when he was chairman of the Senate Judiciary Committee, Biden co-wrote the 1994 crime bill which <em>The<\/em><i>New York Times<\/i><a href=\"https:\/\/www.nytimes.com\/2019\/06\/25\/us\/joe-biden-crime-laws.html\" target=\"_blank\" rel=\"noopener noreferrer\">noted<\/a> last year \u201ccontributed to the explosion of the prison population.\u201d Biden had no sympathy for anyone who violated any law Congress decreed: \u201c<a href=\"https:\/\/www.nytimes.com\/2019\/06\/25\/us\/joe-biden-crime-laws.html\" target=\"_blank\" rel=\"noopener noreferrer\">Lock the S.O.B.s up<\/a>!\u201d Biden <a href=\"https:\/\/www.nytimes.com\/2019\/06\/25\/us\/joe-biden-crime-laws.html\" target=\"_blank\" rel=\"noopener noreferrer\">boasted<\/a> in 1994 that \u201cevery major crime bill since 1976 that\u2019s come out of this Congress\u2026 has had the name of the Democratic senator from the State of Delaware: Joe Biden.\u201d But Biden\u2019s role in the arrest and jailing of hundreds of thousands of Americans has vanished into the Memory Hole during this campaign season.<\/p>\n<p>The violent anti-police protests that proliferated nationwide after the killing of George Floyd is another testament to the failure of the Voting Rights Act. The fact that far more African Americans were enabled to vote did not prevent <a href=\"https:\/\/www.theamericanconservative.com\/articles\/cops-kill-because-we-gave-them-the-legal-framework-to-do-it\/\" target=\"_blank\" rel=\"noopener noreferrer\">police unions from capturing<\/a> the right to accost, abuse, and shoot who they pleased. Politicians prattled about their concern for oppressed minority groups and then refused to repeal laws that entitle government agents to kill with impunity.<\/p>\n<p><strong>Having a vote does nothing to prevent a person from being <a href=\"https:\/\/www.usatoday.com\/story\/opinion\/2018\/10\/15\/christine-blasey-ford-test-tsa-victims-sexual-assault-patdown-column\/1601134002\/\" target=\"_blank\" rel=\"noopener noreferrer\">molested by the Transportation Security Agency<\/a>, spied on by the National Security Agency, or harassed by the Internal Revenue Service. Casting votes has not prevented the federal government from creating <a href=\"https:\/\/www.theguardian.com\/commentisfree\/2013\/jun\/28\/nsa-surveillance-too-many-documents-classified\" target=\"_blank\" rel=\"noopener noreferrer\">trillions of pages of new secrets<\/a> every year.<\/strong> At the state level, possessing the right to vote failed to stop governors from padlocking churches, bankrupting businesses, <a href=\"https:\/\/www.aier.org\/article\/deceit-and-demagoguery-in-montgomery-county-maryland\/\" target=\"_blank\" rel=\"noopener noreferrer\">blighting education<\/a>, and placing scores of millions of Americans under <a href=\"https:\/\/www.politico.com\/news\/2020\/09\/17\/william-barr-coronavirus-lockdowns-slavery-416776\" target=\"_blank\" rel=\"noopener noreferrer\">house arrest<\/a> on the flimsiest epidemiological pretexts during the Covid-19 pandemic.<\/p>\n<p><strong>Politicians talk as if voting magically protects the rights of everyone within a 50-mile radius of the polling booth.<\/strong> Tell that fable to the Americans who voted for George W. Bush in 2000 because he promised a more \u201chumble\u201d foreign policy, to Americans who voted for Barack Obama in 2008 because he promised to restore civil liberties, and to Americans who voted for Trump because he promised to \u201cdrain the swamp\u201d in Washington.<\/p>\n<p><strong>The worst violation of \u201cvoting rights\u201d occurs when election winners capture unlimited power to abuse voters. Ballots failed to prevent every recent American commander-in-chief from expanding and exploiting the dictatorial potential of the presidency.<\/strong> Decades of court decisions have confirmed the de facto legal immunity of the nation\u2019s highest elected official. The term \u201cPandora\u2019s Box\u201d is apparently not part of the playbook provided to federal judges.<\/p>\n<p><strong>Rather than safeguarding rights, elections nowadays usually merely designate who gets to trample them.<\/strong> Regardless of their rhetoric on the campaign trail, there is not a snowball\u2019s chance in hell that either Trump or Biden will \u201cmake America constitutional again.\u201d But presidents and members of Congress cannot violate their oath to uphold the Constitution without making a mockery of any election that they won.<\/p>\n<p>Voting rights controversies are attractive to media outlets that seek to portray this election as a battle between good and evil. But the media almost completely ignores the perennial failure of voting to restrain government power. <strong>As long as it remains infinitely easier for politicians to bind citizens than for citizens to bind politicians, voting rights will continue to be mostly a dangerous mirage.<\/strong><\/p>\n<p>Voting can still be one way to make a statement of one\u2019s principles and preferences.
