So much for a return to normalcy.<\/p>\n<\/div>\n<div class=\"c-single-blog__post-meta c-post-meta \">\n<div class=\"c-post-meta__inner\">\n<p class=\"c-post-meta__date\">January 25, 2021<\/p>\n<p><span class=\"c-post-meta__seperator\">|<\/span><a class=\"c-post-meta__author\" href=\"https:\/\/www.theamericanconservative.com\/author\/james-bovard\/\">James Bovard <\/a><\/p>\n<\/div>\n<\/div>\n<div class=\"c-single-blog__content c-content \">\n<p>The media loved Joe Biden\u2019s inauguration: his platitude-laden speech and his calls for \u201cunity\u201d struck the perfect note for a Washington establishment that wants no more guff from the \u201cdeplorables.\u201d But few commentators stooped to point out the radical changes of Biden\u2019s big day, such as its being the first inaugural since 1865 with the military openly occupying the nation\u2019s capital.<\/p>\n<p>In his inaugural address, Biden <a href=\"https:\/\/www.politico.com\/news\/2021\/01\/20\/joe-biden-inauguration-speech-transcript-full-text-460813\" target=\"_blank\" rel=\"noopener\">castigated<\/a> \u201ca riotous mob [that] thought they could use violence to silence the will of the people.\u201d But politicians invoked that same mob to justify silencing protesters for miles around the inauguration. Biden also declared, \u201cThat\u2019s America. The right to dissent peaceably, within the guardrails of our republic. It\u2019s perhaps this nation\u2019s greatest strength.\u201d Yet during Biden\u2019s inauguration, new \u201cguardrails\u201d drove free speech into the dirt.<\/p>\n<p>The <i>Washington Post,<\/i> a bellwether of the media\u2019s adulation of the new president, had no problem with silencing dissent. Its report on the issue was <a href=\"https:\/\/www.washingtonpost.com\/local\/mall-inauguration-protest\/2021\/01\/16\/cc5743bc-5756-11eb-a931-5b162d0d033d_story.html\" target=\"_blank\" rel=\"noopener\">headlined<\/a>, \u201cIn closing Mall, officials try to strike a balance between the First Amendment and securing Biden\u2019s inauguration.\u201d The \u201cbalance\u201d was achieved by suspending the First Amendment on the most important protest day on the American calendar.<\/p>\n<p>The <i>Post <\/i>noted that only one protest would occur during the Biden inauguration \u201cwith about five demonstrators manning a video screen, tucked away near Union Station, along a secure perimeter, surrounded by largely vacant D.C. streets.\u201d Amazingly, the <i>Post<\/i> portrayed this as proof that the First Amendment had survived: \u201cD.C. and federal officials reached a compromise. They said the plan allows the city\u2019s tradition as the nation\u2019s preeminent stage for protest and free-speech gatherings to continue.\u201d<\/p>\n<p>The federal government dictated so many restrictions on protests that almost all the groups that planned to demonstrate threw in the towel. But that didn\u2019t deter federal officials from taking a victory lap. National Park Service spokesman Mike Litterst <a href=\"https:\/\/www.washingtonpost.com\/local\/mall-inauguration-protest\/2021\/01\/16\/cc5743bc-5756-11eb-a931-5b162d0d033d_story.html\" target=\"_blank\" rel=\"noopener\">declared<\/a>, \u201cWhen the government is under assault, that\u2019s especially a time you do not want to appear to be denying civil liberties or denying people their rights under the First Amendment.\u201d<\/p>\n<p>Federal repression got a seal of approval from an organization long renowned for its uncompromising defense of free speech. Scott Michelman, legal director for the American Civil Liberties Union\u2019s Washington D.C. office, <a href=\"https:\/\/www.washingtonpost.com\/local\/mall-inauguration-protest\/2021\/01\/16\/cc5743bc-5756-11eb-a931-5b162d0d033d_story.html\" target=\"_blank\" rel=\"noopener\">told<\/a> the <i>Post<\/i>:<\/p>\n<div class=\"code-block code-block-3\">\n<div id=\"div-gpt-ad-1573040805625-0\" data-google-query-id=\"COqC_Laet-4CFcpgcgod_7cEvw\">\n<div id=\"google_ads_iframe_\/63118993\/ADN_Players\/TAC_Player_0__container__\"><iframe id=\"google_ads_iframe_\/63118993\/ADN_Players\/TAC_Player_0\" title=\"3rd party ad content\" name=\"google_ads_iframe_\/63118993\/ADN_Players\/TAC_Player_0\" width=\"1\" height=\"1\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\" data-google-container-id=\"9\" data-load-complete=\"true\" data-mce-fragment=\"1\"><\/iframe>&#8220;It\u2019s no question that closing off public spaces, even for a limited time, affects people\u2019s ability to exercise their free-speech rights, but at the same time, the government is permitted to carry out temporary targeted closures of common areas when they have a good reason and aren\u2019t trying to favor one viewpoint over another. If they close the Mall for the inauguration based on a threat, the First Amendment doesn\u2019t prohibit that. If they close the Mall for all of 2021 because there was a threat in January, that is very likely to be overly restrictive.&#8221;<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<p>Very likely? At least the ACLU didn\u2019t endorse shutting down the Mall for the entirety of Biden\u2019s presidency. But neither the federal government nor the District of Columbia government provided clear evidence of an imminent threat that would justify shutting down the Mall and effectively banning protest throughout the vast \u201cGreen Zone\u201d that the feds had declared for the Biden inauguration.<\/p>\n<p>The ACLU sounded happy to see protests suppressed so long as pro-Trump activists were kept off of the streets and the Mall. Michelman explained: \u201cIt can be just as chilling for many would-be demonstrators to know that they\u2019re going to be met with violent counterprotesters as it would be if they were to be met with state violence. Nobody wins when insurrectionists storm the Capitol and wanton violence plays out on the streets of the nation\u2019s capital. That\u2019s not free speech, and that\u2019s not conducive to anyone\u2019s free speech.\u201d<\/p>\n<p>Is Michelman\u2019s horror at protests that erupt into violence selective? A Reuters report <a href=\"https:\/\/www.reuters.com\/article\/us-otc-riot-idUKKBN29H2JC\" target=\"_blank\" rel=\"noopener\">notes<\/a> that Michelman \u201cis representing Black Lives Matter and several individual protesters from a June 1 protest outside of the White House that was dispersed with aggressive police tactics.\u201d Protesters, as law professor Jonathan Turley <a href=\"https:\/\/jonathanturley.org\/2021\/01\/09\/no-the-lafayette-park-protests-were-not-peaceful\/\" target=\"_blank\" rel=\"noopener\">noted<\/a>, injured 75 police officers, hit by \u201cfrozen bottles, bricks and other missiles. For two days, the violence continued with the burning of a historic structure, extensive property damage and the attempted burning down of the historic St. John\u2019s Church.\u201d<\/p>\n<p>Will Biden revive the travesties of the George W. Bush era? Bush pioneered the use of \u201cfree speech zones\u201d to treat protesters as lepers that needed to be kept far from the public and the media, as I <a href=\"https:\/\/www.theamericanconservative.com\/articles\/free-speech-zone\/\" target=\"_blank\" rel=\"noopener\">documented<\/a> in a piece for <em>The American Conservative<\/em> in December 2003. The Bush administration was notorious for seeking to suppress all criticism when the president traveled around the nation. When Bush visited St. Louis shortly before he launched his invasion of Iraq, 150 people carrying protest signs were shunted far away from the main action and effectively quarantined. A local ACLU official complained, \u201cNo one could see them from the street. In addition, the media were not allowed to talk to them. The police would not allow any media inside the protest area and wouldn\u2019t allow any of the protesters out of the protest zone to talk to the media.\u201d<span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/p>\n<p>When Bush visited Columbia, South Carolina, a lone protester with a \u201cNo War for Oil\u201d sign was arrested for \u201centering a restricted area around the President of the United States.\u201d The protester later complained: \u201cThe problem was, the restricted area kept moving. It was wherever I happened to be standing.\u201d When the case went to trial, the Justice Department <a href=\"https:\/\/books.google.com\/books?id=PmyWBgAAQBAJ&amp;pg=PA37&amp;lpg=PA37&amp;dq=%2522second-guess+the+Secret+Service+and+law+enforcement+on+security+decisions%2522&amp;source=bl&amp;ots=arPugzDAeA&amp;sig=ACfU3U2GLhCm9MTjB5S1sGMcWePvPEMlUA&amp;hl=en&amp;sa=X&amp;ved=2ahUKEwiOzu2Myq7uAhWpGFkFHcggALMQ6AEwAHoECAMQAg#v=onepage&amp;q=%2522second-guess%2520the%2520Secret%2520Service%2520and%2520law%2520enforcement%2520on%2520security%2520decisions%2522&amp;f=false\" target=\"_blank\" rel=\"noopener\">asserted<\/a> that no court should have the power to \u201csecond-guess the Secret Service and law enforcement on security decisions\u201d\u2014thus potentially entitling the feds to shut down all future protests in the president\u2019s vicinity. Bush administration abuses spurred a joint letter from the most libertarian and one of the most liberal members of Congress\u2014Congressman Ron Paul and Congressman Barney Frank, respectively\u2014<a href=\"https:\/\/books.google.com\/books?id=PmyWBgAAQBAJ&amp;pg=PA38&amp;lpg=PA38&amp;dq=%2522ask+that+you+make+it+clear+that+we+have+no+interest+as+a+government+in+%25E2%2580%259Czoning%25E2%2580%259D+constitutional+freedoms,+and+that+being+politically+annoying+to+the+president+of+the+United+States+is+not+a+criminal+%2522&amp;source=bl&amp;ots=arPugzDA8E&amp;sig=ACfU3U2KkwkgITvROJKDEfOYZ2RdfVQ7eg&amp;hl=en&amp;sa=X&amp;ved=2ahUKEwjhv-_xya7uAhV-ElkFHTXUCmAQ6AEwAHoECAgQAg#v=onepage&amp;q=%2522ask%2520that%2520you%2520make%2520it%2520clear%2520that%2520we%2520have%2520no%2520interest%2520as%2520a%2520government%2520in%2520%25E2%2580%259Czoning%25E2%2580%259D%2520constitutional%2520freedoms%252C%2520and%2520that%2520being%2520politically%2520annoying%2520to%2520the%2520president%2520of%2520the%2520United%2520States%2520is%2520not%2520a%2520criminal%2520%2522&amp;f=false\" target=\"_blank\" rel=\"noopener\">declaring<\/a> that the entire nation \u201cis a \u2018free speech zone.\u2019 \u2026We ask that you make it clear that we have no interest as a government in \u2018zoning\u2019 constitutional freedoms, and that being politically annoying to the president of the United States is not a criminal offense.\u201d<\/p>\n<p>Another element of Biden\u2019s inaugural address that Washingtonians cherished was his repeated denunciations of \u201cextremism.\u201d This could foreshadow a coming crackdowns on dissent\u2014and the <i>Washington Post <\/i>is again taking the lead<i>. <\/i>On January 18, <i>Post <\/i>columnist Max Boot <a href=\"https:\/\/www.washingtonpost.com\/opinions\/2021\/01\/18\/trump-couldnt-have-incited-sedition-without-help-fox-news\/\" target=\"_blank\" rel=\"noopener\">called<\/a> for reviving Federal Communications Commission censorship of political speech \u201cor else the terrorism we saw on Jan. 6 may be only the beginning\u2026of the plot against America.\u201d Boot continued, \u201cThere is a whole infrastructure of incitement that will remain intact even after Trump leaves office. Just as we do with foreign terrorist groups, so with domestic terrorists: We need to shut down the influencers who radicalize people and set them on the path toward violence and sedition.\u201d Boot praised Britain for having \u201ca government regulator that metes out hefty fines to broadcasters that violate minimal standards of impartiality and accuracy.\u201d Boot is a \u201cglobal affairs analyst\u201d for CNN, where one of the top hosts recently <a href=\"https:\/\/twitter.com\/tomselliott\/status\/1349672644455575554\" target=\"_blank\" rel=\"noopener\">denounced<\/a> all Trump voters as guilty of siding with Nazis and the Klan.<\/p>\n<p>In his inaugural address, Biden proclaimed, \u201cThere is truth and there are lies, lies told for power and for profit.\u201d Biden asserted that \u201cleaders who have pledged to honor our Constitution\u201d have a duty \u201cto defend the truth and defeat the lies.\u201d <strong>\u201cDefeating lies\u201d was practically the motto for the first brazen repression of civil liberties in American history.<\/strong><\/p>\n<p>Eight days after Trump supporters clashed with police at the Capitol, the <i>Post<\/i> ran a piece praising the Sedition Act of 1798\u2014which criminalized \u201cfalse, scandalous and malicious writing or writings against the government of the United States, or either house of the Congress\u2026or the President\u2026with intent to defame the said government\u2026or to bring them\u2026into contempt or disrepute.\u201d University of Notre Dame professor Katlyn Marie Carter <a href=\"https:\/\/www.washingtonpost.com\/outlook\/2021\/01\/14\/what-1798-sedition-act-got-right-what-it-means-today\/\" target=\"_blank\" rel=\"noopener\">praised<\/a> that law for forcing \u201ca conversation about the dangers of misinformation, one we need to have again today.\u201d<\/p>\n<p>But forcing a conversation by putting critics in prison was exactly the type of discussion that the First Amendment prohibited (\u201cCongress shall make no law\u2026\u201d). Carter notes that the law was enacted as \u201ca response to a perceived crisis of misinformation and its potential to undermine trust in elected officials.\u201d If Congress and President John Adams were happy to trample the Bill of Rights, then they deserved all the distrust they garnered. While not calling for reviving the 1798 law, the <i>Post<\/i> piece did fret that \u201callowing misinformation to proliferate in the name of absolute freedom of speech is also dangerous.\u201d<\/p>\n<p>Capitol Hill progressives sound like 1798 revivalists. Congresswoman Alexandria Ocasio-Cortez <a href=\"https:\/\/twitter.com\/tomselliott\/status\/1349329251875614720\" target=\"_blank\" rel=\"noopener\">declared<\/a>, \u201cWe\u2019re going to have to figure out we rein our media environment so that you can\u2019t just spew misinformation and disinformation\u201d and stop people from \u201csaying things that are false.\u201d AOC said that members of Congress are discussing creating a \u201ccommission\u201d to solve the problem. Politicians trust themselves to be Veracity Czars, even though only <a href=\"https:\/\/www.statista.com\/statistics\/207579\/public-approval-rating-of-the-us-congress\/\" target=\"_blank\" rel=\"noopener\">15 percent<\/a> of Americans approve of Congress. A phalanx of law professors will be happy to assist the suppression. As Michael Barone <a href=\"https:\/\/nypost.com\/2021\/01\/17\/the-left-wants-to-silence-conservatives-all-of-them\/\" target=\"_blank\" rel=\"noopener\">pointed out<\/a>, \u201cYale\u2019s Robert Post laments that \u2018the formation of public opinion is out of control\u2019; the University of California, Irvine\u2019s Rick Hasen laments \u2018a market failure when it comes to reliable information voters need\u2019; Columbia University\u2019s Tim Wu suggests \u2018the weaponization of speech\u2019 makes First Amendment jurisprudence \u2018increasingly obsolete.\u2019\u201d<\/p>\n<p>Is speculation about a rising censorship peril misguided, considering the euphoric atmosphere in Washington over Biden taking power? Remember that the Bush administration exploited a presidential popularity surge after the 9\/11 attacks to crack down on dissent. Nor is there grounds for optimism in Biden\u2019s half-century record in Washington.
