The TSA could also heavily fine people for wearing a facemask improperly and maybe also for some other offenses the agency hasn\u2019t yet created. It is ironic that a federal agency that helped compound the Covid pandemic just captured more arbitrary power over any American citizen who needs to catch a flight.<\/p>\n<p>The TSA mask mandate was perhaps inevitable with a new president who <a href=\"https:\/\/www.cnbc.com\/2020\/08\/13\/joe-biden-calls-for-a-nationwide-mask-mandate-to-combat-coronavirus.html\">portrays forcing people to<\/a> wear masks as the 21<sup>st<\/sup> century version of the Emancipation Proclamation. Airlines have a right to require masks of their passengers and to refuse service to customers who refuse to comply, regardless of the <a href=\"https:\/\/www.aier.org\/article\/the-sketchy-claims-of-the-case-for-a-mask-mandate\/\">studies raising questions<\/a> on the efficacy of masks.<strong> But the TSA\u2019s new regulations could become another bureaucratic Pandora\u2019s Box from an agency with a long <a href=\"https:\/\/www.usatoday.com\/story\/opinion\/2018\/07\/31\/tsa-transportation-security-administration-secretly-watching-quiet-skies-surveillance-column\/862810002\/\">history<\/a> of <a href=\"https:\/\/thehill.com\/blogs\/pundits-blog\/civil-rights\/344466-tsa-justifies-searches-with-op-eds-more-than-facts-is-my\">pointlessly<\/a> <a href=\"https:\/\/www.usatoday.com\/story\/opinion\/2018\/07\/31\/tsa-transportation-security-administration-secretly-watching-quiet-skies-surveillance-column\/862810002\/\">vexing<\/a> <\/strong><a href=\"https:\/\/www.latimes.com\/opinion\/op-ed\/la-oe-bovard-tsa-watchlist-20180528-story.html\"><strong>Americans.<\/strong><\/a><\/p>\n<p>The new TSA regulation mandates: \u201c<a href=\"https:\/\/www.tsa.gov\/sites\/default\/files\/sd-1582_84-21-01.pdf\">Mask should fit snugly<\/a> but comfortably against the side of the face.\u201d How will TSA checkpoint screeners assure compliance? Will they run their fingers between the mask and the face to assure sufficient tightness \u2013 the same way TSA agents are notorious <a href=\"https:\/\/www.usatoday.com\/story\/opinion\/2018\/10\/15\/christine-blasey-ford-test-tsa-victims-sexual-assault-patdown-column\/1601134002\/\">for fondling<\/a> female <a href=\"https:\/\/blog.gladrags.com\/2010\/11\/24\/tsa-groin-searches-menstruating-woman\/\">travelers<\/a>\u2019 <a href=\"https:\/\/www.soupbeforesupper.com\/flying-while-female\/\">panty liners<\/a>? Regulations also prohibit \u201cmasks that do not fit properly (large gaps, too loose or too tight).\u201d Will we have a Goldilocks and the three bears\u2019 porridge \u201cmaybe so, maybe not\u201d routine here? Any procedure which involves TSA agents pawing travelers\u2019 masks boosts the risk of contagion.<\/p>\n<p>The TSA gravely warns that \u201c<a href=\"https:\/\/www.tsa.gov\/news\/press\/releases\/2021\/01\/31\/tsa-implement-executive-order-regarding-face-masks-airport-security\">passengers without a<\/a> mask may be denied entry, boarding, or <a href=\"https:\/\/www.zerohedge.com\/covid-19\/cdc-and-tsa-form-federal-mask-police-and-enforcement-officer-discretion\">continued transport<\/a>.\u201d Will maskless travelers be ejected at 35,000 feet, or what?<\/p>\n<p>The federal Centers for Disease Control issued new regulations for public transit that parallel TSA rules. The CDC specified that facemasks can be temporarily removed during flights if \u201c<a href=\"https:\/\/www.cdc.gov\/coronavirus\/2019-ncov\/travelers\/face-masks-public-transportation.html\">wearing of oxygen<\/a> masks is needed because of loss of cabin pressure.\u201d If the plane hits the ground as a result of whatever problem caused \u201closs of cabin pressure,\u201d masks can probably be removed then as well.<\/p>\n<p>The <em>Washington Post <\/em>reported TSA assurances that \u201cpeople subject to the civil penalties <a href=\"https:\/\/www.washingtonpost.com\/transportation\/2021\/02\/05\/tsa-mask-fines\/\">will have due process<\/a>.\u201d <strong>But will this be another federal facade in which \u201cdue process\u201d is simply \u201ca process an agency does?<\/strong>\u201d People hit with facemask fines will have \u201cthe right to an informal conference with TSA.\u201d However, \u201cSpecific data will not be available until after all legal proceedings are completed, which could take an extended period of time,\u201d the TSA warned.<\/p>\n<p>We\u2019ve seen this kangaroo court routine from the TSA before. In 2002, after the TSA covertly concocted a system of fines to punish traveler\u2019s bad attitudes, it failed to give people warning or notice, failed to define the key terms, and failed to notify violators of their right to appeal. In an obscure <em>Federal Register <\/em>notice that 99.99% of Americans never heard about, the TSA disclosed that travelers could be fined or arrested if anything they said or did caused a screener to \u201cturn away from his or her normal duties <a href=\"https:\/\/books.google.com\/books?id=umXgCgAAQBAJ&amp;pg=PA175&amp;lpg=PA175&amp;dq=tsa+%22%E2%80%9Cturn+away+from+his+or+her+normal+duties+to+deal+with+the+disruptive+individual%22&amp;source=bl&amp;ots=9NiJygya17&amp;sig=ACfU3U02AihZg2R8E9dG--ee0n5ZBq7zWw&amp;hl=en&amp;sa=X&amp;ved=2ahUKEwj9g_OBltnuAhUaFVkFHdJ6B-0Q6AEwE3oECCQQAg#v=onepage&amp;q=tsa%20%22%E2%80%9Cturn%20away%20from%20his%20or%20her%20normal%20duties%20to%20deal%20with%20the%20disruptive%20individual%22&amp;f=false\">to deal with the disruptive<\/a> individual.\u201d The TSA did not clearly define the new crime. TSA spokeswoman Ann Davis told the <em>New York Times<\/em> in 2004 that the offense included \u2018\u2018<a href=\"https:\/\/www.nytimes.com\/2004\/03\/02\/business\/business-travel-on-the-road-airport-hurdles-and-the-nonflying-nuns.html\">any nonphysical situation<\/a> that in any way would interfere with the screener and his or her ability to continue to work, or interfere with their ability to do their jobs.\u201d Few travelers realized they could be financially hammered for almost anything that perturbed a TSA screener. Thousands of Americans were hit with fines of up to $1,500 sometimes weeks after their flight.<\/p>\n<p>Appointing the TSA as mask enforcers is ironic considering the agency\u2019s record as one of the nation\u2019s <a href=\"https:\/\/www.propublica.org\/article\/the-tsa-hoarded-1-3-million-n95-masks-even-though-airports-are-empty-and-it-doesnt-need-them?utm_source=fark&amp;utm_medium=website&amp;utm_content=link&amp;ICID=ref_fark\">most notorious hoarders<\/a> of unused masks early in the pandemic. At a time when health care workers treating Covid patients had no reliable masks, the TSA held on to a stash of 1.3 million N95 facemasks which it also failed to distribute to its own employees. TSA attorney Charles Kielkopf filed a whistleblower complaint charging that the TSA was guilty of \u201c<a href=\"https:\/\/www.ibtimes.com\/tsa-allegedly-hoards-over-13m-masks-following-airport-traffic-drop-amid-covid-19-2972246\">gross mismanagement that<\/a> represented a \u2018substantial and specific danger to public health.\u2019\u201d<\/p>\n<p>But that was the least of the TSA\u2019s contributions to catastrophe. Jay Brainard, the TSA\u2019s top official in Kansas, publicly complained last June that TSA agents \u201c<a href=\"https:\/\/apnews.com\/article\/9fc7a047c051b431cefc2f840502866c\">became Typhoid Marys<\/a> and contributed to the spread of that virus because TSA senior leadership did not make sure (screeners) were adequately protected.\u201d Brainard was prohibited by TSA headquarters from requiring TSA agents in Kansas to wear masks. Early in the pandemic, a top TSA official testified to Congress that TSA agents regularly changed their nitrile gloves after patting down passengers. However, several TSA federal security directors at airports nationwide told National Public Radio that the policy had been that \u201c<a href=\"https:\/\/www.npr.org\/2020\/06\/19\/880564586\/whistleblower-tsa-failed-to-protect-staff-endangered-passengers-during-pandemic\">gloves are changed<\/a> between pat-downs only in the specific situation when an alarm is set off.\u201d<\/p>\n<p>After NPR\u2019s report, the TSA announced that \u201cpassengers would now be allowed to request TSA screeners change their gloves.\u201d But would travelers get fined for a bad attitude for suggesting that TSA agents change their gloves? Any gynecologist who followed the same grossly negligent policy on changing gloves \u2013 only if patients requested a fresh pair \u2013 would soon be out of business. Brainard said the TSA was guilty of \u201cgross mismanagement\u201d and failed to \u201ctake <a href=\"https:\/\/www.npr.org\/2020\/06\/19\/880564586\/whistleblower-tsa-failed-to-protect-staff-endangered-passengers-during-pandemic\">adequate steps<\/a> to make sure that we were not becoming carriers and spreaders of the virus ourselves.\u201d<\/p>\n<p>If the TSA wants to become less of a menace to public health, there are simple reforms that would also help return decency to flying. The TSA deployed its Whole Body Scanners without adequate testing a decade ago. The scanners produce endless false alarms which require TSA screeners to get up-close-and-personal with travelers, pawing boobs, butts, and anything else to find bombs and weapons that never exist. TSA screeners also <a href=\"https:\/\/www.usatoday.com\/story\/opinion\/2015\/06\/05\/tsa-failure-security-abuses-column\/28490923\/\">miss almost all<\/a> of <a href=\"https:\/\/abcnews.go.com\/US\/exclusive-undercover-dhs-tests-find-widespread-security-failures\/story?id=31434881\">the mock bombs<\/a> and weapons that covert testers squirreled through the airports. The metal detecting magnetometers that the TSA used prior to Whole Body Scanners are as reliable at detecting threats and far less invasive (who wants a nude photo in their federal dossier?) and less likely to generate false positives.<\/p>\n<p>Perhaps the TSA\u2019s biggest source of false positives is its explosive detection tests that function as a full employment program for slow-witted feds. The TSA tests swabs from passengers or their luggage on devices which <a href=\"https:\/\/www.usatoday.com\/story\/opinion\/2016\/03\/21\/tsa-full-body-scanners-patdowns-gitmo-fourth-amendment-privacy-column\/81779330\/\">generate false positives for<\/a> any trace of <a href=\"https:\/\/www.nbcdfw.com\/news\/local\/common-lotion-ingredient-sets-off-explosives-screening-at-airport\/1961221\/\">glycerin<\/a> \u2013 practically an omnipresent substance in this high anxiety age of hand sanitizers. The false positives require a full groping that accomplishes nothing except another statistical checkoff in the war against anything that might be mislabeled as terrorism.<\/p>\n<p><strong>Can the TSA reform its searches and other procedures so that its own employees avoid getting denounced as \u201cTyphoid Marys?\u201d Is \u201csocial distancing\u201d from boneheaded enforcement agents asking too much? Alas, it is difficult to expect reasonable policies from an agency that still seems inspired by one of its first mottoes<\/strong>: \u201c<a href=\"https:\/\/www.theguardian.com\/commentisfree\/cifamerica\/2012\/apr\/18\/tsa-mission-creep-us-police-state\">Dominate. Intimidate.
