Emergency proclamations have entitled presidents and other government officials to seize vast new powers previously forbidden to them. Government bureaucrats became a new priesthood that could sanctify unlimited sacrifices merely by invoking dubious statistical extrapolations of future perils.<\/strong><\/p>\n<p>In October, Freedom House issued a report, <a href=\"https:\/\/freedomhouse.org\/article\/new-report-democracy-under-lockdown-impact-covid-19-global-freedom\">Democracy under Lockdown \u2013 The Impact of COVID-19 on Global Freedom,<\/a> which warned that since the pandemic started, \u201cthe condition of democracy and human rights has worsened in 80 countries.\u201d Sarah Repucci, co-author of the report, warned that \u201cgovernments\u2019 responses to the pandemic are eroding the pillars of democracy around the world.\u201d <strong>Abuses of power have been propelled by a presumption that government officials are entitled to all the power they claim to need to keep people safe.\u00a0<\/strong><\/p>\n<p><strong>When the pandemic arrived in America, governors in many states responded by dropping the equivalent of a Reverse <a href=\"https:\/\/www.airforcemag.com\/article\/the-neutron-bomb\/\">Neutron Bomb<\/a> \u2013 something which destroys the economy while supposedly leaving human beings unharmed.<\/strong> New York Governor Andrew Cuomo set the standard when he effectively declared that he was entitled to inflict any burden on his state\u2019s residents to \u201c<a href=\"https:\/\/nypost.com\/2020\/03\/20\/todays-coronavirus-update-trump-closes-borders-new-york-locks-down\/\">save just one life<\/a>.\u201d Michigan Governor Gretchen Whitmer <a href=\"https:\/\/www.foxnews.com\/politics\/michigan-stay-at-home-order-now-bans-visits-to-friends-relatives-governor-says\">prohibited anyone from leaving their home<\/a> to visit family or friends. Los Angeles Mayor Eric Garcetti banned people from <a href=\"https:\/\/dailycaller.com\/2020\/12\/03\/los-angeles-mayor-eric-garcetti-covid-restrictions-ban-walking-traveling\/\">walking or bicycling<\/a> outside. More than ten million jobs were lost thanks to lockdowns, a major reason <a href=\"https:\/\/www.nytimes.com\/2021\/02\/18\/us\/covid-life-expectancy.html\">why life expectancy<\/a> in the United States last year had its sharpest plunge since World War Two.<\/p>\n<p>Australia imposed some of the most heavy-handed restrictions. In August, the state of Victoria dictated an 8 p.m. to 5 a.m. curfew for the Melbourne area and prohibited people from venturing more than three miles from their residence. Victoria Premier Daniel Andrews decreed: \u201cWhere you <a href=\"https:\/\/reason.com\/2020\/08\/03\/australia-imposes-curfews-closes-internal-borders-to-slow-covid-19-pandemic\/\">slept last night<\/a> is where you\u2019ll need to stay for the next six weeks.\u201d Melbourne has been hit <a href=\"https:\/\/www.usnews.com\/news\/world\/articles\/2021-02-16\/australias-second-largest-city-comes-out-of-3rd-lockdown\">by repeated lockdowns<\/a> since then.<\/p>\n<p>Britain unleashed some of the most absurd restrictions. In June, it prohibited couples who live in different homes <a href=\"https:\/\/www.independent.co.uk\/news\/uk\/home-news\/coronavirus-sex-lockdown-law-couples-indoors-england-a9542171.html?utm_medium=Social&amp;utm_source=Twitter#Echobox=1591011688\">from having sex indoors<\/a>. The <em>Independent<\/em> (U.K.) noted, \u201cPeople who have sex outside can be punished under pre-existing laws on outraging public decency and indecent exposure.\u201d Steve Watson reported in January for <em>Summit News<\/em> that British cabinet ministers \u201c have privately debated preventing people from <a href=\"https:\/\/summit.news\/2021\/01\/11\/uk-government-may-only-let-people-out-once-a-week\/\">talking to each other<\/a> in the street and in supermarkets, and even preventing people from leaving home more than once per week, and introducing curfews.\u201d British vaccines minister Nadhim Zahawi fretted, \u201cI\u2019m worried about some of the pictures I\u2019ve seen of social interactions in parks, if you have to exercise you can go out for exercise only.\u201d Apparently, a national vow of silence is necessary to fight Covid. <em>Summit News<\/em> noted, \u201cPolice are also demanding new powers to force entry into the homes of suspected lockdown violators.\u201d Former British Supreme Court Justice Jonathan Sumption complained last month, \u201cForeign travel is being prohibited, turning us into <a href=\"https:\/\/www.dailymail.co.uk\/debate\/article-9231807\/Zero-Covid-mirage-says-JONATHAN-SUMPTION-virus-stay.html\">a hermit island<\/a> on the basis we cannot know what mutations may be lurking out there. The logic of these policies is that we must be locked down for ever simply because the world is a dangerous place.\u201d<\/p>\n<p>New Zealand has imposed four separate lockdowns in its pursuit to banish the virus from the island, repeatedly placing residents in the capital city under house arrest. In October, the government announced it was creating \u201cquarantine centers\u201d for anyone who tests positive and refuses to obey government orders. One Twitter wag scoffed, \u201cNew Zealand went <a href=\"https:\/\/twitter.com\/SallyMayweather\/status\/1322354744892006401\">from gun bans to concentration camps<\/a> in less than a year.\u201d<\/p>\n<p>Covid horrors have been more dramatic in some developing nations. In Uganda, as the <a href=\"https:\/\/www.economist.com\/international\/2020\/10\/17\/the-pandemic-has-eroded-democracy-and-respect-for-human-rights\"><em>Economist<\/em> reported<\/a>, Francis Zaake, a member of parliament, delivered food to his neediest constituents during a pandemic lockdown. But \u201cUganda\u2019s President Yoweri Museveni has ordered that only the government may hand out food aid. Anyone else who does so can be charged with murder, Mr Museveni has threatened, since they might do it in a disorderly way, attract crowds and thereby spread the coronavirus.\u201d<\/p>\n<p>Police and soldiers forcibly entered Zaake\u2019s house and \u201cdragged him into a van and threw him in a cell. He says they beat, kicked and cut him, crushed his testicles, sprayed a blinding chemical into his eyes, called him a dog and told him to quit politics. He claims that one sneered: \u2018We can do whatever we want to you or even kill you\u2026No one will demonstrate for you because they are under lockdown.\u2019\u201d<\/p>\n<p>In Kenya, police killed at least <a href=\"https:\/\/www.theguardian.com\/global-development\/2020\/oct\/23\/brutal-policing-kenyas-covid-curfew-left-15-dead\">15 people during<\/a> brutal crackdowns on alleged violators of lockdown decrees. Amnesty International declared that the Covid-19 pandemic provided \u201cthe perfect storm for indiscriminate mass violence\u201d by the police, thanks to the \u201cpervasive culture of impunity among [police] service members who rely on systemic corruption.\u201d<\/p>\n<p><strong>Journalists in many nations risked their hides if they violated politicians\u2019 monopoly on fear-mongering. A<\/strong>lmost a hundred nations have imposed new restrictions on freedom of speech and freedom of the press since the pandemic began. <a href=\"https:\/\/freedomhouse.org\/article\/new-report-democracy-under-lockdown-impact-covid-19-global-freedom\">Freedom House<\/a> reported: \u201cGovernments enacted new legislation against spreading \u2018fake news\u2019 about the virus. They also limited independent questioning at press conferences, suspended the printing of newspapers, and blocked websites.\u201d Reporters Without Borders, a nonprofit for press freedom, warned, \u201cMost governments yielded to the temptation, using a <a href=\"https:\/\/rsf.org\/en\/news\/covid-19-emergency-laws-spell-disaster-press-freedom\">variety of repressive measures<\/a>\u2026, of making official channels the only credible and authoritative sources of information.\u201d Many regimes have expanded the definition of \u201cfake news\u201d to justify repression:<\/p>\n<ul>\n<li>\u201cIn Ethiopia, the definition of <a href=\"https:\/\/rsf.org\/en\/news\/covid-19-emergency-laws-spell-disaster-press-freedom\">misinformation is so<\/a> broad that it gives the authorities the discretionary power to declare any piece of information false.\u201d<\/li>\n<li>\u201cIn India, Egypt, Botswana and Somalia, only government statements on the subject may be published.\u201d<\/li>\n<li>\u201cIn Cambodia, the government gave itself the legal power to ban the publication of \u201cany information that could cause unrest, fear or disorder.\u201d<\/li>\n<li>In Rwanda, the journalist who runs the YouTube news channel Ishema TV was imprisoned for violating Covid lockdown regulations. \u201cAt the time of his arrest he was reporting on the effects of the lockdown on the population and <a href=\"https:\/\/rsf.org\/en\/reports\/2020-pandemic-has-challenged-press-freedom-africa\">investigating allegations<\/a> of rape committed by soldiers enforcing the lockdown,\u201d Reporters without Borders notes.<\/li>\n<li>In Zimbabwe, anyone \u201cwho publishes or disseminates \u2018false\u2019 information about an official, or that impedes the response to the pandemic, faces up <a href=\"https:\/\/www.economist.com\/international\/2020\/10\/17\/the-pandemic-has-eroded-democracy-and-respect-for-human-rights?fsrc=newsletter&amp;utm_campaign=the-economist-today&amp;utm_medium=newsletter&amp;utm_source=salesforce-marketing-cloud&amp;utm_term=2020-10-16&amp;utm_content=article-link-1&amp;etear=nl_today_1\">to 20 years in prison<\/a>,\u201d the <em>Economist<\/em> reported.<\/li>\n<li>Tanzania suffered a wave of censorship after the nation\u2019s president publicly denounced Covid-19 as a \u201cWestern plot.\u201d \u201cSeveral news outlets, including the country\u2019s leading Swahili-language newspaper Mwananchi, were <a href=\"https:\/\/rsf.org\/en\/reports\/2020-pandemic-has-challenged-press-freedom-africa\">closed down<\/a> after publishing stories about Covid-19. Others were forced to broadcast apologies after carrying reports on the subject which angered the authorities,\u201d Reporters without Borders noted.<\/li>\n<li>In Thailand, Amnesty International reported, \u201cauthorities are prosecuting social media users who criticize the government and monarchy in a <a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2020\/04\/thailand-authorities-using-repressive-laws-to-intensify-crackdown-on-online-critics\/\">systematic campaign to crush<\/a> dissent which is being exacerbated by new COVID-19 restrictions. Authorities have wasted no time using existing repressive laws in order to <a href=\"https:\/\/reason.com\/2020\/05\/01\/freedom-is-a-pandemic-casualty-in-authoritarian-regimes-and-liberal-democracies\/\">censor \u2018false\u2019 communications<\/a> related to COVID-19.\u201d The government decreed five-year prison sentences for any Thai journalists or media outlets that published information officials decree to be \u201c<a href=\"https:\/\/rsf.org\/en\/news\/thailand-uses-covid-19-restrict-freedom-inform\">capable of causing fear<\/a> in the public.\u201d<\/li>\n<\/ul>\n<p><strong>\u201cGovernment knows best\u201d is the subtext for arbitrary decrees issued around the world. An Associated Press article in January explained why Californians were denied access to the information that determined the fate of their freedom: \u201cState health officials said they rely on a very complex set of measurements that <a href=\"https:\/\/apnews.com\/article\/sacramento-california-coronavirus-pandemic-gavin-newsom-38bb44ea7cb39eab9f6f6c621daeaf10\">would confuse and potentially mislead<\/a> the public if they were made public.\u201d But many data-driven dictatorial policies relied on data that was either fraudulent, politically contrived, or laughably inaccurate.<\/strong> On the day that Joe Biden was <a href=\"https:\/\/www.who.int\/news\/item\/20-01-2021-who-information-notice-for-ivd-users-2020-05\">inaugurated as president<\/a>, the World Health Organization changed the test standard for defining Covid cases, guaranteeing that far fewer \u201ccases\u201d would be reported and thereby making a mockery of the previous 10 months data.<\/p>\n<p>The pandemic\u2019s precedents pose a long-term peril for liberty around the globe. Freedom House expects that \u201cofficial responses to COVID-19 have laid the groundwork for <a href=\"https:\/\/freedomhouse.org\/article\/new-report-democracy-under-lockdown-impact-covid-19-global-freedom\">government excesses<\/a> that could affect democracy for years to come.\u201d This was foreseeable from the start of the pandemic but the media in some Western nations were the <a href=\"https:\/\/www.aier.org\/article\/dont-cry-for-donald-mcneil\/\">biggest cheerleaders<\/a> for obliterating limits on political power. The secrecy that proliferated during the pandemic will make it harder for citizens to recognize how badly they have been misgoverned.<\/p>\n<p>Going forward, citizens in many nations might appreciate this old adage from American politics: \u201cThe Constitution isn\u2019t perfect but it\u2019s better than what we have now.\u201d Federal judge William Stickman IV declared in September, \u201cBroad population-wide lockdowns are such a <a href=\"https:\/\/news.bloomberglaw.com\/us-law-week\/pennsylvania-covid-restrictions-unconstitutional-judge-says\">dramatic inversion of<\/a> the concept of liberty in a free society as to be nearly presumptively unconstitutional.\u201d But <strong>unless there is a similar stark ruling from the Supreme Court, shutdowns could return whenever politicians can panic enough citizens with some new threat.<\/strong><\/p>\n<p>Lockdown victims around the globe would be wise to heed Thomas Jefferson\u2019s 1798 warning that the doctrine \u201cthat the general government is the exclusive judge of the extent of the powers delegated to it [is] nothing <a href=\"https:\/\/billofrightsinstitute.org\/primary-sources\/virginia-and-kentucky-resolutions\">short of despotism<\/a>; since the discretion of those who administer the government, and not the Constitution, would be the measure of their powers.\u201d <strong>The pandemic painfully illustrated how government officials can always concoct the data to justify whatever decree they itch to issue. And regardless of the needless deaths and disruptions caused by government policies, it will be the opponents of lockdowns who will <a href=\"https:\/\/www.thedailybeast.com\/dr-birx-says-its-devastatingly-worrisome-that-anti-lockdown-protesters-arent-wearing-masks\">be labeled grandma-killers<\/a>.<\/strong><\/p>\n<p>The Biden administration is reviving America\u2019s <a href=\"https:\/\/www.washingtonpost.com\/opinions\/global-opinions\/how-about-biden-needs-new-ways-to-fight-for-democracy-here-are-some-ideas\/2021\/02\/19\/fca8104e-7152-11eb-93be-c10813e358a2_story.html\">proselytizing for democracy<\/a> around the globe. But<strong> Covid-19 crackdowns are a warning for people to be wary of oppressive governments regardless of their purported mandate.
