{"id":15782,"date":"2021-04-09T08:08:50","date_gmt":"2021-04-09T12:08:50","guid":{"rendered":"https:\/\/jimbovard.com\/blog\/?p=15782"},"modified":"2021-04-09T16:54:53","modified_gmt":"2021-04-09T20:54:53","slug":"will-supremes-unleash-biden-red-flag-gun-raids","status":"publish","type":"post","link":"https:\/\/jimbovard.com\/blog\/2021\/04\/09\/will-supremes-unleash-biden-red-flag-gun-raids\/","title":{"rendered":"Will Supremes Unleash Biden Red Flag Gun Raids?"},"content":{"rendered":"<h3>American Conservative, April 9, 2021<\/h3>\n<h1 class=\"c-single-blog__title c-title wow animated\"><a href=\"https:\/\/www.theamericanconservative.com\/articles\/will-supremes-unleash-biden-red-flag-gun-raids\/\"><span class=\"c-title-inner\">Will Supremes Unleash Biden Red Flag Gun Raids?<\/span><\/a><\/h1>\n<div class=\"c-single-blog__subtitle c-subtitle \">\n<p class=\"c-subtitle__inner\">A gun seizure case before the Supreme Court could open the flood gates to warrantless searches.<\/p>\n<\/div>\n<div class=\"c-single-blog__post-meta c-post-meta \">\n<div class=\"c-post-meta__inner\">\n<p><a class=\"c-post-meta__author\" href=\"https:\/\/www.theamericanconservative.com\/author\/james-bovard\/\">by\u00a0 James Bovard <\/a><\/p>\n<\/div>\n<\/div>\n<div class=\"c-single-blog__content c-content \">\n<p>President Joe Biden launched his <a href=\"https:\/\/www.washingtonpost.com\/politics\/biden-to-nominate-official-from-gun-control-group-to-head-atf\/2021\/04\/07\/1f0ef6d4-97d2-11eb-962b-78c1d8228819_story.html\" target=\"_blank\" rel=\"noopener\">first attack on the Second Amendment<\/a> this week, making clear his intent to radically curtail Americans\u2019 legal rights to own firearms. The White House boasted that Biden was nominating <a href=\"https:\/\/trendingpolitics.com\/breaking-biden-announces-6-gun-control-executive-actions-and-its-just-the-beginning-knab\/\" target=\"_blank\" rel=\"noopener\">a \u201cfierce\u201d advocate<\/a> of gun control, David Chipman, to be chief of the Alcohol Tobacco and Firearms (ATF) agency. Chipman, a former ATF agent, is so dedicated to banning assault weapons that he <a href=\"https:\/\/dailycaller.com\/2021\/04\/07\/david-chipman-atf-biden-waco-branch-davidians\/\" target=\"_blank\" rel=\"noopener\">brazenly lied last year<\/a> about the 1993 federal assault at Waco, claiming that the Branch Davidians shot down two National Guard helicopters that were <a href=\"https:\/\/dailycaller.com\/2021\/04\/07\/david-chipman-atf-biden-waco-branch-davidians\/\" target=\"_blank\" rel=\"noopener\">assaulting their home<\/a>. Chipman, a Phillips Exeter Academy graduate who carries a concealed weapon himself, was an ATF case agent at the 1994 trial of the Branch Davidian survivors so he had no excuse for tossing out this anti-gun fairy tale.<\/p>\n<p>Perhaps the biggest peril<strong> that Biden unveiled is his push for a national \u201cred flag\u201d law that would entitle the police to preemptively confiscate the guns of anyone who is accused of being a threat to himself or others. Red flag laws have been notorious for <a href=\"https:\/\/reason.com\/2019\/08\/07\/red-flag-laws-leave-gun-owners-defenseless\/\" target=\"_blank\" rel=\"noopener\">trampling due process<\/a> and spurring unjustified police raids that have resulted in <a href=\"https:\/\/baltimore.cbslocal.com\/2018\/11\/05\/fatal-officer-involved-shooting-in-anne-arundel-county\/\" target=\"_blank\" rel=\"noopener\">killing innocent gun owners<\/a>. It is na\u00efve to expect fair play on gun owners\u2019 rights when the politicians driving such policy are openly seeking pretexts to disarm as many Americans as possible.<\/strong> Biden\u2019s push for a red flag law could become far more perilous to constitutional rights if the Supreme Court upholds a <a href=\"https:\/\/www.scotusblog.com\/2021\/03\/theres-no-place-like-home\/\" target=\"_blank\" rel=\"noopener\">potentially landmark gun seizure case<\/a> that could gut the Fourth Amendment\u2019s prohibition against warrantless searches. The Court heard arguments in this case last month and a decision is expected by June.<\/p>\n<p>In 2015, after an elderly couple had a heated argument, Edward Caniglia placed an unloaded revolver on the table and taunted his wife: \u201cWhy don\u2019t you <a href=\"https:\/\/www.courthousenews.com\/just-shoot-me-plea-brought-the-police-and-high-court-battle\/\" target=\"_blank\" rel=\"noopener\">just shoot me<\/a> and get me out of my misery?\u201d His wife, Kim, was spooked and left to stay overnight in a hotel. When he didn\u2019t answer a phone call the next morning, she called the police and asked them to check on him.<\/p>\n<p>Police arrived and browbeat Edward Caniglia into getting get a psychiatric examination at a hospital. He agreed to do so only after police promised not to seize his handguns. The shrinks certified him as sane (at least by prevailing Rhode Island standards) and he returned home to learn the police had confiscated his guns. Both he and his wife requested the guns be returned. Police refused to do so until Caniglia, who had no history of violence or abusing firearms, filed a lawsuit. Caniglia also sued the city of Cranston and police officers for violating his constitutional rights.<\/p>\n<p>At first glance, his case rested upon solid precedent. The Supreme Court <a href=\"https:\/\/www.aclu.org\/cases\/caniglia-v-strom\" target=\"_blank\" rel=\"noopener\">ruled in 1980<\/a>, \u201cIt is a basic principle of Fourth Amendment law that searches and seizures inside a home without a warrant are presumptively unreasonable.\u201d\u00a0 In 1948, <a href=\"https:\/\/www.law.cornell.edu\/supremecourt\/text\/335\/451\" target=\"_blank\" rel=\"noopener\">the Supreme Court declared<\/a> that the sanctity of private homes is \u201ctoo precious to entrust to the discretion of those whose job is the detection of crime and the arrest of criminals.\u201d But the police and their supporters relied on a vast expansion of a 1973 Supreme Court decision that justified a <a href=\"https:\/\/constitutioncenter.org\/blog\/a-conflict-at-home-creates-conflict-over-the-fourth-amendment-in-the-u.s-supreme-court\" target=\"_blank\" rel=\"noopener\">warrantless \u201cinventory search\u201d<\/a> of a rent-a-car to seek a police officer\u2019s revolver in the trunk as part of the \u201ccommunity caretaking\u201d exemption to the Fourth Amendment. A federal judge and a federal appeals court, ruling in favor of Rhode Island police, effectively concluded that a private home was \u201cclose enough for government work\u201d to a rent-a-car to justify warrantless searches.<\/p>\n<p>But what about that clarion call 1967 Supreme Court <a href=\"https:\/\/constitutioncenter.org\/blog\/katz-v-united-states-the-fourth-amendment-adapts-to-new-technology\/\" target=\"_blank\" rel=\"noopener\">decision that declared<\/a>, \u201cWherever a man may be, he is entitled to know that he will remain free from unreasonable searches and seizures.\u201d\u00a0 Not a problem, according to the first amicus brief that the Biden administration filed with the Supreme Court. According to <a href=\"https:\/\/www.justice.gov\/osg\/brief\/caniglia-v-strom\" target=\"_blank\" rel=\"noopener\">the Biden administration<\/a>, the only question in the Rhode Island case was whether the actions of police officers in the case were \u201cobjectively reasonable.\u201d Constitutional rights were effectively moot because the Cranston cops were simply dealing with \u201can impending safety threat through a warrantless seizure of a potentially mentally unstable person and an entry into his residence for the limited purpose of removing firearms.\u201d For the Biden legal team, \u201cconfiscating\u201d became \u201cremoving\u201d as smoothly as one of Falstaff\u2019s minions turned \u201cstealing\u201d into \u201cconveying.\u201d<\/p>\n<p>On the same side of the fight, Marc DeSisto, the lawyer representing the Cranston police officers, <a href=\"https:\/\/thehill.com\/regulation\/court-battles\/544733-supreme-court-wary-of-curbing-police-efforts-to-prevent-suicide\" target=\"_blank\" rel=\"noopener\">declared<\/a>, \u201cThe Fourth Amendment has only one test and that is that searches and seizures shall not be unreasonable.\u201d DeSisto was not required to take a literacy test and perhaps was unaware of the Fourth Amendment passage about Americans\u2019 rights to \u201cbe secure\u2026 against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.\u201d DeSisto and the Biden administration presume that warrants are unnecessary, if not irrelevant, any time government officials assert that it is \u201creasonable\u201d to enter someone\u2019s house without a warrant \u201cto ensure public health and safety.\u201d\u00a0 And<strong> who defines \u201creasonableness\u201d? The same government officials who violate the Constitution.<\/strong> As Justice Stephen Breyer <a href=\"https:\/\/www.forbes.com\/sites\/nicksibilla\/2021\/03\/27\/supreme-court-considers-fourth-amendment-exception-to-let-cops-seize-guns-without-a-warrant\/?sh=31a20273189f\" target=\"_blank\" rel=\"noopener\">commented<\/a>, \u201cIf you take a caretaker exception and read that into the word \u2018reasonable,\u2019 there\u2019s no stopping. We don\u2019t know how far we\u2019ll go.\u201d<\/p>\n<p>Lawyer Shay Dvoretzky, who represented Caniglia before the Court, <a href=\"https:\/\/www.forbes.com\/sites\/nicksibilla\/2021\/03\/27\/supreme-court-considers-fourth-amendment-exception-to-let-cops-seize-guns-without-a-warrant\/?sh=56e75bb7189f\" target=\"_blank\" rel=\"noopener\">warned<\/a>,<\/p>\n<blockquote><p>\u201cNearly every criminal violation has public safety implications, so dispensing with the warrant requirement whenever police can point to a health or safety motive would eviscerate the Fourth Amendment. Virtually any criminal situation can also be described in health or safety terms. For any situation involving drugs and alcohol, police could just say they were going into the home in order to make sure that the suspect was okay.\u201d<\/p><\/blockquote>\n<p>As Justice Neil Gorsuch <a href=\"https:\/\/www.forbes.com\/sites\/nicksibilla\/2021\/03\/27\/supreme-court-considers-fourth-amendment-exception-to-let-cops-seize-guns-without-a-warrant\/?sh=1c16a05f189f\" target=\"_blank\" rel=\"noopener\">asked<\/a>, \u201cWhat does the government do that doesn\u2019t involve health or safety?\u201d Institute for Justice attorney <a href=\"https:\/\/ij.org\/press-release\/ij-urges-supreme-court-to-reject-dangerous-expansion-of-community-caretaking-doctrine\/\" target=\"_blank\" rel=\"noopener\">Joshua Windham wrote<\/a>, \u201cA rule that allows police to burst into your home without a warrant whenever they feel they are acting as \u2018community caretakers\u2019 is a threat to everyone\u2019s security.\u201d A brief filed jointly by the American Civil Liberties Union, Cato Institute, and American Conservative Union Foundation <a href=\"https:\/\/www.forbes.com\/sites\/alisondurkee\/2021\/03\/24\/supreme-court-caniglia-v-strom-weighs-allowing-police-to-enter-homes-without-a-warrant-for-caretaking\/?sh=3ee98a354313\" target=\"_blank\" rel=\"noopener\">warned that upholding<\/a> the Rhode Island search could \u201cgive police free rein to enter the home without probable cause or a warrant\u201d and would be \u201cunwise, unmanageable, and unnecessary, and it opens the door to abusive police conduct.\u201d<\/p>\n<p>The Biden administration\u2019s animosity to the Second Amendment has raised the stakes for the Rhode Island case. The Second Amendment Law Center, the California Rifle and Pistol Association, and Gun Owners of California <a href=\"https:\/\/www.forbes.com\/sites\/nicksibilla\/2021\/03\/27\/supreme-court-considers-fourth-amendment-exception-to-let-cops-seize-guns-without-a-warrant\/?sh=77485dd6189f\" target=\"_blank\" rel=\"noopener\">warned the Supreme Court<\/a> that<\/p>\n<blockquote><p>\u201cthe Fourth Amendment has no \u2018gun\u2019 exception\u2026 Expansion of the \u2018community caretaking\u2019 exception into the home will be used by police in jurisdictions with onerous or constitutionally-questionable firearm restrictions to turn every call to a house into a search for guns under the pretext of \u2018helping\u2019 those present.\u201d<\/p><\/blockquote>\n<p>Anyone who doubts whether warrantless \u201ccommunity caretaking\u201d could open an authoritarian Pandora\u2019s box should read the transcript of the Supreme Court hearing. Lawyer <a href=\"https:\/\/www.washingtonpost.com\/politics\/courts_law\/supreme-court-police-warrants\/2021\/03\/24\/38bb9ed2-8cda-11eb-9423-04079921c915_story.html\" target=\"_blank\" rel=\"noopener\">DeSisto asserted<\/a> that the caretaking doctrine would also authorize police raids to enforce mandatory COVID mask requirements if \u201cthey can see a lot of people gathered together that are not wearing masks.\u201d Gov. Cuomo is again the bellwether here. In November, Cuomo denounced New York county sheriffs for <a href=\"https:\/\/thehill.com\/homenews\/state-watch\/527263-cuomo-calls-a-sheriff-who-wont-enforce-mask-mandate-a-dictator\" target=\"_blank\" rel=\"noopener\">acting like a \u201cdictator\u201d<\/a> because they refused to forcibly enter private homes to enforce Cuomo\u2019s mask mandate. Since the start of the Pandemic, Biden has whooped up masks as if they were a silver bullet to slap COVID-19 (regardless that tens of\u00a0 millions of Americans have been infected with the virus since mask <a href=\"https:\/\/www.prnewswire.com\/news-releases\/83-of-americans-report-that-they-always-wear-a-face-mask-when-out-in-public-according-to-new-state-by-state-survey-findings-from-slickdeals-301164658.html\" target=\"_blank\" rel=\"noopener\">compliance reached over 80 percent<\/a> in public places). Biden has already mandated <a href=\"https:\/\/www.aier.org\/article\/masking-americas-greatest-natural-monuments\/\" target=\"_blank\" rel=\"noopener\">wearing masks in National Parks<\/a> and on federal property. How much further could he go if there is another surge of Covid cases?<\/p>\n<p>Justice Sandra Sotomayor <a href=\"https:\/\/reason.com\/2021\/03\/25\/sonia-sotomayor-questions-warrantless-gun-seizure-in-big-fourth-amendment-case\/\" target=\"_blank\" rel=\"noopener\">commented during the hearing<\/a>, \u201cWhen we permit police to search and seize without some standard, we run the risk of situations like this [Rhode Island case] repeating themselves.\u201d But many antigun activists view the case as a model, not as a glitch in the legal system. Some court watchers expect a victory for the Biden position; <a href=\"https:\/\/www.reuters.com\/article\/us-usa-court-police\/with-the-elderly-in-mind-u-s-supreme-court-wary-of-limiting-police-in-home-entries-idUSKBN2BG2PX\" target=\"_blank\" rel=\"noopener\">Reuters headlined<\/a> its report on the hearing, \u201cWith the elderly in mind, U.S. Supreme Court wary of limiting police in home entries.\u201d Defenders of the Rhode Island gun seizure insist that government officials need discretion to forcibly protect people against themselves. But consider the experience of New Yorkers under the Secure Ammunition and Firearms Enforcement (SAFE) Act, which Gov. Andrew Cuomo railroaded into law immediately after a 2012 school shooting in Connecticut. <a href=\"https:\/\/www.usnews.com\/news\/articles\/2013\/04\/03\/-gun-control-debate-clouds-definition-of-mentally-ill\" target=\"_blank\" rel=\"noopener\">Cuomo declared<\/a>: \u201cPeople who have mental health issues should not have guns. They could hurt themselves, they could hurt other people.\u201d But tens of millions of Americans visit therapists each year, and \u201cmental health issues\u201d is vague enough for endless political mischief.<\/p>\n<p>More than 85,000 New Yorkers lost their Second Amendment rights as a result of a \u201cmental health\u201d exclusion clause in the SAFE Act. As columnist <a href=\"https:\/\/reason.com\/2014\/10\/20\/if-you-want-to-keep-your-guns-in-new-yor\/\" target=\"_blank\" rel=\"noopener\">Jacob Sullum observed<\/a>, the \u201claw effectively gives \u2018mental health professionals\u2019 the power to disarm people, and they do not even need a judge\u2019s approval.\u201d New York University law professor James Jacobs <a href=\"https:\/\/www.themarshallproject.org\/2015\/12\/02\/new-york-disarms-the-mentally-ill\" target=\"_blank\" rel=\"noopener\">observed that<\/a>, \u201cbased on as little as a single short emergency room interview,\u201d an individual \u201cneed not even be notified that his or her name has been added to a database of persons whose firearms license must be revoked and whose firearms must be surrendered.\u201d Medical professionals and others were already legally obliged to notify police if a patient \u201cmade a credible threat\u201d of violence but the provision in the 2013 act was far more expansive.<\/p>\n<p>If the Supreme Court approves \u201cwellness check\u201d warrantless gun raids, the Biden administration could invoke the American Psychiatric Associations Diagnostic Statistic Manual (DSM) category <a href=\"https:\/\/en.wikipedia.org\/wiki\/Oppositional_defiant_disorder\" target=\"_blank\" rel=\"noopener\">313.81, Oppositional Defiant Disorder,<\/a> to justify targeting outspoken opponents of the government. After the clash at the Capitol, Biden wasted no time denouncing the January 6 protestors as \u201cdomestic terrorists.\u201d Press accounts of the arrests of the protestors breathlessly recounted how many firearms were found in their homes\u2014regardless that those individuals did not tote their AR-15s, shotguns, and Glocks with them when they \u201cunlawfully entered\u201d that \u201c<a href=\"https:\/\/news.yahoo.com\/us-capitol-temple-democracy-authoritarian-184146277.html\" target=\"_blank\" rel=\"noopener\">Temple of Democracy<\/a>,\u201d the U.S. Capitol. Any such crackdown would have legions of cheerleaders in the mainstream media.<\/p>\n<p>The Biden administration\u2019s support for warrantless \u201ccommunity caretaking\u201d police raids must be viewed in light of previous perverse legal innovations that unleashed tyranny. Going back to the 18th century, British and American judges recognized that \u201ca man\u2019s home is his castle.\u201d But the drug war obliterated that notion with legal doctrines that should have been laughed out of court. Instead, the combined peril of narcotics and flush toilets nullified limits on police power. In a 1995 brief to the Supreme Court, Clinton\u2019s <a href=\"https:\/\/fee.org\/articles\/property-and-liberty\/\" target=\"_blank\" rel=\"noopener\">Justice Department stressed<\/a> that \u201cvarious indoor plumbing facilities\u2026 did not exist\u201d in early America when the \u201cknock-and-announce\u201d rule for searches of homes was adopted. In a 1997 brief to the Supreme Court, the <a href=\"https:\/\/books.google.com\/books?id=w7AaCgAAQBAJ&amp;pg=PT96&amp;lpg=PT96&amp;dq=CLINTON+ADMINISTRATION+1997+SUPREME+COURT+%22is+ordinarily+reasonable+for+police+officers+to+dispense+with+a+pre-entry+knock+and+announcement%22&amp;source=bl&amp;ots=jJw6hBGWph&amp;sig=ACfU3U0LUWu3423RezDRq6bOBvkz4IMksw&amp;hl=en&amp;sa=X&amp;ved=2ahUKEwjO6PD04-zvAhVJElkFHUSdALYQ6AEwAHoECAMQAw#v=onepage&amp;q=CLINTON%20ADMINISTRATION%201997%20SUPREME%20COURT%20%22is%20ordinarily%20reasonable%20for%20police%20officers%20to%20dispense%20with%20a%20pre-entry%20knock%20and%20announcement%22&amp;f=false\" target=\"_blank\" rel=\"noopener\">Clinton administration declared<\/a> that \u201cit is ordinarily reasonable for police officers to dispense with a pre-entry knock and announcement.\u201d The <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/520\/385\/\" target=\"_blank\" rel=\"noopener\">subsequent Supreme Court<\/a> decision included a few quibbles but effectively sanctified no-knock raids whenever police claimed a \u201creasonable suspicion\u201d that evidence might be destroyed. The <i>New York Times <\/i><a href=\"https:\/\/www.nytimes.com\/interactive\/2017\/03\/18\/us\/forced-entry-warrant-drug-raid.html\" target=\"_blank\" rel=\"noopener\">noted in 2017<\/a> that no-knock warrants were routinely granted permitting \u201cthe most extreme force in pursuit of the smallest amounts of drugs, since a few grams are more quickly flushed than a few bales.\u201d The Clinton \u201cflush the Fourth\u201d doctrine spurred an explosion of deadly no-knock raids across the nation. A <i>New York Times <\/i><a href=\"https:\/\/www.nytimes.com\/interactive\/2017\/03\/18\/us\/forced-entry-warrant-drug-raid.html\" target=\"_blank\" rel=\"noopener\">investigation found<\/a> that \u201cat least 81 civilians and 13 law enforcement officers died in raids from 2010 through 2016. Scores of others were maimed or wounded.\u201d<\/p>\n<p><strong>\u201cGovernment as a damn rascal\u201d was the unwritten premise of the Bill of Rights.<\/strong> The Founding Fathers saw enough depredations by British agents that they recognized the folly of vesting officialdom with absolute power.
