Carlson sought \u201cto sow distrust [of the NSA], which is so anti-American,\u201d declared <a href=\"https:\/\/www.foxnews.com\/media\/tucker-mueller-deputy-ripping-nsa-claim\" target=\"_blank\" rel=\"noopener noreferrer\">MSNBC analyst Andrew Weissman<\/a>, formerly the chief prosecutor for Special Counsel Robert Mueller. Do pundits presume that there is a 24-hour statute of limitation for recalling any previously-disclosed NSA crimes and abuses?<\/p>\n<p><strong>The Carlson controversy cannot be understood outside the context of perennial NSA abuses.<\/strong> The NSA possesses a \u201crepository capable of taking in 20 billion \u2018record events\u2019 daily and making them available to NSA analysts within 60 minutes,\u201d the New York Times <a href=\"https:\/\/www.nytimes.com\/2013\/09\/29\/us\/nsa-examines-social-networks-of-us-citizens.html\" target=\"_blank\" rel=\"noopener noreferrer\">reported<\/a>. The NSA is able to snare and stockpile many orders of magnitude times more information than did East Germany\u2019s Stasi secret police, one of the most odious agencies of the post-war era.<\/p>\n<p>The FBI, for its part, is permitted to rummage through the seized data under strict restrictions. In 2018, the Foreign Intelligence Surveillance (FISA) court <a href=\"https:\/\/www.nytimes.com\/2019\/10\/08\/us\/politics\/fbi-fisa-court.html\">slammed the FBI<\/a> for abusing that database with warrantless searches that violated Americans\u2019 rights. After the FBI promised to repent, the FISA court to permitted FBI agents to continue rummaging in NSA troves. In April, the FISA court revealed that the FBI surveillance crime wave continues.<\/p>\n<p>The FBI conducted <a href=\"https:\/\/www.washingtonpost.com\/national-security\/fbi-surveillance-privacy-violations\/2021\/04\/26\/608f342a-a696-11eb-8d25-7b30e74923ea_story.html\">warrantless searches<\/a> of the data trove for \u201cdomestic terrorism,\u201d \u201cpublic corruption and bribery,\u201d \u201chealth care fraud,\u201d and other targets \u2014 including people who notified the FBI of crimes and even repairmen entering FBI offices. If you <a href=\"https:\/\/www.washingtonpost.com\/national-security\/fbi-surveillance-privacy-violations\/2021\/04\/26\/608f342a-a696-11eb-8d25-7b30e74923ea_story.html\">sought to report a crime<\/a> to the FBI, an FBI agent may have illegally surveilled your email. Even if you merely volunteered for the FBI \u201cCitizens Academy\u201d program, the FBI may have illegally tracked all your online activity.<\/p>\n<div id=\"\/10519169\/dailycaller_inline2\" class=\"ad\" align=\"center\" data-google-query-id=\"CLnr9tnv6vECFchCDQodSlUOHA\">\n<div id=\"google_ads_iframe_\/10519169\/dailycaller_inline2_0__container__\"><iframe id=\"google_ads_iframe_\/10519169\/dailycaller_inline2_0\" title=\"3rd party ad content\" name=\"google_ads_iframe_\/10519169\/dailycaller_inline2_0\" width=\"300\" height=\"250\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\" data-google-container-id=\"7\" data-load-complete=\"true\" data-mce-fragment=\"1\"><\/iframe><\/div>\n<\/div>\n<p>In 2019, the FBI unjustifiably searched the database for information on 16,000 people \u201ceven though only seven of them had connections to an investigation,\u201d the <a href=\"https:\/\/www.nytimes.com\/2021\/04\/26\/us\/politics\/fbi-fisa-surveillance.html\">New York Times reported<\/a>. FISA court Chief Judge James Boasberg lamented \u201capparent widespread violations\u201d of the legal restrictions for FBI searches <a href=\"https:\/\/www.washingtonpost.com\/national-security\/fbi-surveillance-privacy-violations\/2021\/04\/26\/608f342a-a696-11eb-8d25-7b30e74923ea_story.html\">but shrugged them off<\/a> and permitted the scouring of Americans\u2019 personal data to continue.<\/p>\n<p>On June 30, Americans learned that one of NSA\u2019s most intrusive surveillance engines is still being widely abused. In 2013, Edward Snowden revealed that <a href=\"https:\/\/www.theguardian.com\/world\/interactive\/2013\/jul\/31\/nsa-xkeyscore-program-full-presentation\">that the XKeyscore<\/a> program was being used to commandeer the email and Internet data of any American who was caught \u201csearching the web for suspicious stuff.\u201d XKeyscore enables NSA analysts to wiretap anyone simply by entering the target\u2019s email address into the database. Six months after Snowden\u2019s disclosures began, federal judge Richard Leon issued a ruling denouncing the NSA surveillance regime as <a href=\"https:\/\/www.theatlantic.com\/politics\/archive\/2013\/12\/federal-judge-nsas-almost-orwellian-phone-data-collection-likely-violates-constitution\/356207\/\">almost Orwellian<\/a>: \u201cI cannot imagine a more indiscriminate and arbitrary invasion than this systematic and high-tech collection and retention of personal data on virtually every single citizen for purposes of querying and analyzing it without prior judicial approval.\u201d<\/p>\n<p>Travis LeBlanc, a member of the Privacy and Civil Liberties Oversight Board, released his declassified dissent to that civil liberties watchdog board recent report on XKeyscore. Hundreds of illegal or prohibited searches were apparently committed using XKeyscore in 2019. LeBlanc complained that the oversight board failed to ask \u201chow many U.S. persons <a href=\"https:\/\/www.washingtonpost.com\/context\/statement-travis-leblanc-privacy-and-civil-liberties-oversight-board\/7db0c0e7-7cc5-40c3-a22f-857172a6dcd6\/?itid=lk_inline_manual_7\">have been impacted<\/a> by XKeyscore, how much data the program collects and analyzes, how widely information analyzed through XKeyscore is shared.\u201d<\/p>\n<p>However, the oversight board did not even \u201crequest specific information\u201d about violations of U.S. law by NSA.<\/p>\n<p><strong>Americans have probably not seen even the tip of the iceberg of NSA abuses.<\/strong> NSA apparently never even bothered doing a formal analysis of the legality or constitutionality of XKeyscore until 2016, after the oversight board specifically requested such information. LeBlanc <a href=\"https:\/\/www.washingtonpost.com\/national-security\/nsa-surveillance-xkeyscore-privacy\/2021\/06\/29\/b2134e7a-d685-11eb-a53a-3b5450fdca7a_story.html\" target=\"_blank\" rel=\"noopener noreferrer\">told the Washington Post:<\/a>\u00a0\u201cWhat concerns me most is that we have a very powerful surveillance program that eight years or so after exposure, still has no judicial oversight, and what I consider to be inadequate legal analysis and serious compliance infractions.\u201d<\/p>\n<p>Oregon Democratic Senator Ron Wyden, the most dogged congressional watchdog of federal spying, <a href=\"https:\/\/www.washingtonpost.com\/national-security\/nsa-surveillance-xkeyscore-privacy\/2021\/06\/29\/b2134e7a-d685-11eb-a53a-3b5450fdca7a_story.html\" target=\"_blank\" rel=\"noopener noreferrer\">declared<\/a> that \u201cAmericans still know far too little about the government\u2019s surveillance activities\u2026 and how it threatens their privacy.\u201d Wyden, a member of the Senate Intelligence Committee, is muzzled from disclosing the NSA\u2019s confidential dirt.<\/p>\n<p><strong>NSA is like an accused murderer who continually proclaims his innocence up until the moment a video surfaces of him pulling the trigger<\/strong>. After Carlson stated that his emails were being intercepted, <a href=\"https:\/\/www.washingtonpost.com\/politics\/2021\/06\/30\/tucker-carlson-is-credibility-battle-with-nsa-so-far-hes-losing\/\" target=\"_blank\" rel=\"noopener noreferrer\">the NSA issued a statement<\/a> declaring that \u201cTucker Carlson has never been an intelligence target of the Agency\u2026 With limited exceptions (e.g. an emergency), NSA may not target a US citizen without a court order that explicitly authorizes the targeting.\u201d<\/p>\n<p>However, 90% of the people whose emails and other data were dragged into NSA surveillance dragnets were <a href=\"https:\/\/www.washingtonpost.com\/world\/national-security\/in-nsa-intercepted-data-those-not-targeted-far-outnumber-the-foreigners-who-are\/2014\/07\/05\/8139adf8-045a-11e4-8572-4b1b969b6322_story.html?itid=lk_interstitial_manual_37\">not NSA\u2019s actual targets<\/a>, according to a 2014 Washington Post analysis based on data that Snowden provided. Shortly before Snowden\u2019s disclosures began, National Intelligence Director <a href=\"https:\/\/www.politifact.com\/truth-o-meter\/article\/2014\/mar\/11\/james-clappers-testimony-one-year-later\/\">James Clapper lied to Congress<\/a> when he denied that the NSA collects \u201cany type of data at all on millions, or hundreds of millions of Americans.\u201d He was never charged for that crime, thereby encouraging falsehoods by every subsequent top federal intelligence official.<\/p>\n<p>On July 7, Axios reported that \u201cCarlson was talking to U.S.-based Kremlin intermediaries about <a href=\"https:\/\/www.axios.com\/tucker-carlson-putin-interview-surveillance-c9952d7c-33d7-45e9-be68-2ba4c3817f98.html\">setting up an interview<\/a> with Vladimir Putin shortly\u201d before he accused the NSA of spying on him. U.S. government officials became aware of Carlson\u2019s effort to interview Putin. Axios noted the possibility that \u201cone of the people Carlson was talking to as an intermediary to help him get the Putin interview was under [NSA] surveillance as a foreign agent.\u201d<\/p>\n<p>But NSA would still be prohibited from disclosing emails from an American citizen after \u201cunmasking\u201d his identity. As journalist Glenn Greenwald noted, \u201cIt is one of the <a href=\"https:\/\/bigleaguepolitics.com\/tucker-carlson-and-glenn-greenwald-discuss-the-orwellian-implications-of-the-nsa-leaking-personal-communication-of-journalists\/\">gravest crimes<\/a> in the U.S. code for the NSA to leak the contents of communications that it intercepts between a foreign official and an American citizen.\u201d<\/p>\n<p>In an interview scheduled for release on Monday (previewed by the Daily Mail), Carlson explained that he went public with his NSA charge \u201cdefensively\u2026 I don\u2019t have subpoena power. I can\u2019t arrest anybody. I <a href=\"https:\/\/www.dailymail.co.uk\/news\/article-9774451\/Tucker-Carlson-defends-using-accuse-NSA-spying-him.html\">can\u2019t make them<\/a> answer questions.\u201d An investigative producer for Carlson\u2019s show did file a Freedom of Information Act (FOIA) request with the NSA, seeking \u201cany call records, texts, or emails <a href=\"https:\/\/www.buzzfeednews.com\/article\/jasonleopold\/tucker-carlson-nsa-foia-request\">the NSA has obtained<\/a> from journalist Tucker Carlson\u2019s cell phone or email,\u201d among other information.<\/p>\n<p><strong>Unfortunately, FOIA has long since become a sham<\/strong>. The Obama White House <a href=\"https:\/\/www.usatoday.com\/story\/opinion\/2019\/06\/27\/loss-foia-scotus-government-keep-food-stamp-data-secret-column\/1559162001\/\">drove nails into the FOIA coffin<\/a> by inventing the doctrine of \u201cWhite House equities,\u201d permitting political appointees to delay embarrassing disclosures for years (instead of the 20 business days the law requires). Obama\u2019s Justice Department <a href=\"https:\/\/www.pogo.org\/analysis\/2011\/11\/did-your-foia-request-really-not-exist-or-is-that-just-what-doj-told-you\/\">formally proposed<\/a>\u00a0to permit federal agencies to falsely claim that FOIA-requested documents did not exist. Such travesties did not deter the media from repeating Obama\u2019s boast of having \u201cthe <a href=\"https:\/\/reason.com\/2017\/01\/18\/the-most-transparent-administr\/\">most transparent administration in history<\/a>.\u201d<\/p>\n<p><strong>NSA\u2019s power and prerogatives have been buttressed by the vast increase in federal secrecy in recent decade<\/strong>s. Since the 1990s, the number of documents classified annually by the feds increased more than tenfold. Federal agencies are now <a href=\"https:\/\/www.theguardian.com\/commentisfree\/2013\/jun\/28\/nsa-surveillance-too-many-documents-classified\">creating trillions of pages<\/a>\u00a0of new secrets each year, and each page is backed by a federal fist waiting to crush anyone who makes an unauthorized disclosure. Congress and the media have been complicit in tolerating the Iron Curtain that shrouds far too many federal abuses.<\/p>\n<p>But Carlson has nothing to fear because the NSA is constrained by checks and balances elsewhere in the government, right? Fat chance. <strong>Any pretense that Deep State surveillance agencies were on a legal leash should have been destroyed by RussiaGat<\/strong>e.<\/p>\n<p>In December 2019, the Justice Department Inspector General reported that the <a href=\"https:\/\/www.justice.gov\/storage\/120919-examination.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">FBI<\/a> made \u201cfundamental errors\u201d and persistently deceived the FISA court to authorize surveilling a 2016 Donald Trump presidential campaign official, Carter Page. Former FBI assistant general counsel Kevin Clinesmith admitted to falsifying key evidence to secure the FISA warrant to spy on the Trump campaign.<\/p>\n<p>As a Wall Street Journal <a href=\"https:\/\/www.wsj.com\/articles\/fisa-vs-liberty-11611953179\">editorial noted<\/a>, Clinesmith \u201cchanged an email confirming Page had been a CIA source to one that said the exact opposite, explicitly adding the words \u2018not a source\u2019 before he forwarded it.\u201d A federal prosecutor declared that the \u201cresulting harm is immeasurable\u201d from Clinesmith\u2019s action. But at the sentencing hearing, Judge Boasberg <a href=\"https:\/\/www.politico.com\/news\/2021\/01\/29\/fbi-lawyer-trump-russia-probe-email-463750\" target=\"_blank\" rel=\"noopener noreferrer\">gushed with sympathy<\/a>: \u201cMr. Clinesmith has lost his job in government service\u2014what has given his life much of its meaning.\u201d Scorning the federal prosecutor\u2019s recommendation for jail time, Boasberg gave Clinesmith a wrist slap\u2014400 hours of community service and 12 months of probation.<\/p>\n<p><strong>The FISA court has gone from pretending that federal surveillance violations don\u2019t occur to <em>pretending that such crimes don\u2019t matter<\/em>. Practically the only remaining task is for the FISA court to cease pretending Americans have any constitutional right to privacy.<\/strong><\/p>\n<p>Tucker Carlson may or may not be in NSA cross-hairs at the moment, but there are plenty of other Americans who should be sweating. Capitol Police acting Chief Yogananda Pittman <a href=\"http:\/\/www.newsweek.com\/capitol-police-chief-calls-january-6-riot-terrorist-attack-1564594\">told<\/a> Congress that the Jan. 6 riots were \u201ca terrorist attack by tens of thousands of insurrectionists.\u201d Does federal law enforcement believe that any Trump supporter within a mile radius of the U.S. Capitol that day was a terrorist?<\/p>\n<p>President Joe Biden\u2019s nominee to lead the Bureau of Alcohol, Tobacco, Firearms and Explosives David Chipman favors <a href=\"https:\/\/thehill.com\/homenews\/senate\/555592-atf-nominee-tells-lawmakers-he-supports-ar-15-ban\">banning more than ten<\/a> million AR-15 rifles owned by American citizens. The Biden administration is claiming a right to know whether every American has <a href=\"https:\/\/news.yahoo.com\/absolutely-business-know-gets-vaccinated-145900809.html\">been vaccinated for Covid<\/a> and will be sending its agents door-to-door to harangue people who are unjabbed. Considering the Biden administration\u2019s histrionic rhetoric on \u201cdomestic terrorism,\u201d guns, and COVID-19, it would take only a few tweaks in NSA searches to pull up vast troves of new offenders who could be targeted.<\/p>\n<p>Glenn Greenwald recently observed that \u201cthe Democratic Party and journalism, in general, has <a href=\"https:\/\/www.washingtontimes.com\/news\/2021\/jul\/1\/glenn-greenwald-calls-out-liberals-who-loved-his-n\/\">aligned with the CIA<\/a>, the NSA and the FBI, and has aligned and merged with the security state.\u201d But there was a time when Democrats were eloquent defenders against federal intrusions.<\/p>\n<p>Democrat House Majority Leader Hale Boggs of Louisiana explained in 1971 that \u201cFreedom of speech, freedom of thought, freedom of action for men in public life can be compromised quite as effectively by <a href=\"https:\/\/www.hsdl.org\/?view&amp;did=479920\">the fear of surveillance<\/a> as by the fact of surveillance.\u201d<\/p>\n<p>Democratic Sen. Among deprivations of rights, none is so effective in cowing a population, crushing the spirit of the individual and putting terror in every heart.\u201d<\/p>\n<p><strong>Americans cannot acquiesce to illegal government surveillance without forfeiting their right to the tattered remnants of their privacy<\/strong>. The feds need to come clean on any surveillance and leaks that may have targeted Tucker Carlson or otherwise violated his rights.
