That mandate is being challenged by <a class=\"gnt_ar_b_a\" href=\"https:\/\/www.koco.com\/article\/oklahoma-lawsuit-covid-19-vaccine-mandate-health-care-workers\/38266013\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">numerous state attorneys general<\/a>.<strong> This case could be a bellwether on the fate of civil liberties during and after the COVID-19 pandemic.<\/strong><\/p>\n<p class=\"gnt_ar_b_p\"><strong>The Biden administration has consistently portrayed vaccines as a pandemic panacea.<\/strong> In July, Biden <a class=\"gnt_ar_b_a\" href=\"https:\/\/www.politifact.com\/factchecks\/2021\/jul\/22\/joe-biden\/biden-exaggerates-efficacy-covid-19-vaccines\/\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">promised<\/a>, \u201cYou\u2019re not going to get COVID\u00a0if you have these vaccinations.\u201d When he announced plans to impose the mandate in a Sept. 9 speech, Biden <a class=\"gnt_ar_b_a\" href=\"https:\/\/www.whitehouse.gov\/briefing-room\/speeches-remarks\/2021\/09\/09\/remarks-by-president-biden-on-fighting-the-covid-19-pandemic-3\/\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">declared<\/a> that &#8220;there\u2019s only one confirmed positive case per 5,000 fully vaccinated Americans per day. You\u2019re as safe as possible.\u201d<\/p>\n<p class=\"gnt_ar_b_p\">Biden vastly overstated vaccine efficacy in part because the Centers for Disease Control and Prevention had ceased to count\u00a0the vast majority of breakthrough infections several months earlier. <a class=\"gnt_ar_b_a\" href=\"https:\/\/www.washingtonpost.com\/health\/2021\/08\/18\/cdc-data-delay-delta-variant\/\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">The Washington Post reported\u00a0<\/a>that the CDC\u2019s \u201coverly rosy assessments of the vaccines\u2019 effectiveness against delta &#8230; may have lulled Americans into a false sense of security.\u201d<\/p>\n<h2 class=\"gnt_ar_b_h2\">Vaccines will\u00a0not end this pandemic<\/h2>\n<p class=\"gnt_ar_b_p\"><a class=\"gnt_ar_b_a\" href=\"https:\/\/www.federalregister.gov\/documents\/2021\/11\/05\/2021-23831\/medicare-and-medicaid-programs-omnibus-covid-19-health-care-staff-vaccination\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">More than half a million health care workers<\/a> have already had COVID-19\u00a0infections and more than 99%\u00a0of them survived.\u00a0However, the Biden mandate presumes that vaccines are the sole source of good health and protection and ignored post-infection immunity because of <a class=\"gnt_ar_b_a\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/21\/21A240\/206915\/20211230120003811_Response%20to%20Stay%20Application.pdf\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">perceived<\/a> \u201cuncertainties \u2026 as to the strength and length\u00a0of (natural)\u00a0immunity.\u201d<\/p>\n<p class=\"gnt_ar_b_p\">However, <a class=\"gnt_ar_b_a\" href=\"https:\/\/www.science.org\/content\/article\/having-sars-cov-2-once-confers-much-greater-immunity-vaccine-vaccination-remains-vital\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">a major Israeli study<\/a>\u00a0in August\u00a0found that people who had COVID-19 have\u00a0far better protection against the delta variant\u00a0than people who have received multiple COVID-19 vaccine injections.<\/p>\n<p class=\"gnt_ar_b_p\">According to a brief from the states of Missouri and Nebraska, Biden\u2019s mandate &#8220;<a class=\"gnt_ar_b_a\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/21\/21A240\/206915\/20211230120003811_Response%20to%20Stay%20Application.pdf\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">threatens economic ruin and patient harm<\/a> throughout the (health care) industry\u201d and \u201cwill have disastrous consequences on (health care) particularly in rural communities.\u201d<\/p>\n<p class=\"gnt_ar_b_p\">Louisiana Attorney General Jeff Landry derided the Biden administration for giving health care workers a <strong>&#8220;<a class=\"gnt_ar_b_a\" href=\"https:\/\/georgiarecorder.com\/2021\/12\/01\/vaccine-mandate-for-health-care-workers-halted-nationwide-by-louisiana-judge\/\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">jab or job<\/a>&#8221; ultimatum.<\/strong><\/p>\n<p class=\"gnt_ar_b_p\">The Federal Register notice on the new mandate dismissed concerns about the loss of health care staff because \u201c<a class=\"gnt_ar_b_a\" href=\"https:\/\/www.federalregister.gov\/documents\/2021\/11\/05\/2021-23831\/medicare-and-medicaid-programs-omnibus-covid-19-health-care-staff-vaccination\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">there is insufficient evidence to quantify<\/a>\u201d the impact.<\/p>\n<p class=\"gnt_ar_b_p\">Across the nation, <a class=\"gnt_ar_b_a\" href=\"https:\/\/www.wsj.com\/articles\/some-hospitals-drop-covid-19-vaccine-mandates-to-ease-labor-shortages-11639396806\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">thousands of health care workers<\/a> have been fired for refusing to get injected, including many\u00a0who have natural immunity after surviving COVID-19 infections. In New York, a hospital closed its <a class=\"gnt_ar_b_a\" href=\"https:\/\/www.npr.org\/2021\/09\/13\/1036521499\/covid-workers-resign-new-york-hospital-stops-baby-delivery\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">maternity ward<\/a> and <a class=\"gnt_ar_b_a\" href=\"https:\/\/www.wwnytv.com\/2021\/10\/01\/smc-other-hospitals-help-deliver-babies-after-lewis-county-maternity-ward-closes\/\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">ceased delivering babies<\/a> because of a shortage of vaccinated nurses. And one health system is <a class=\"gnt_ar_b_a\" href=\"https:\/\/www.usatoday.com\/story\/news\/2021\/11\/24\/mvhs-loses-more-workers-vaccine-mandate-limits-services\/8737782002\/\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">curtailing elective and nonemergency surgeries<\/a> and\u00a0reducing radiology treatment in part because of loss of health personnel due to the vaccine mandate.<\/p>\n<p class=\"gnt_ar_b_p\">\u00a0Biden <a class=\"gnt_ar_b_a\" href=\"https:\/\/www.cnbc.com\/2021\/12\/21\/omicron-us-to-deploy-troops-to-hospitals-purchase-500-million-covid-tests.html\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">responded <\/a>to shortages of critical personnel by planning to send\u00a0in 1,000 U.S. military personnel to assist hospitals.<\/p>\n<h2 class=\"gnt_ar_b_h2\">A maddening mandate<\/h2>\n<p class=\"gnt_ar_b_p\">In its brief to the Supreme Court, the Biden administration declared that the vaccine <a class=\"gnt_ar_b_a\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/21\/21A240\/205449\/20211216174120640_Biden%20v.%20Missouri%20-%20CMS%20Vaccine%20Mandate%20Stay%20Application.pdf\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">mandate<\/a> was \u201ccritical to preventing outbreaks\u00a0of (COVID-19)\u00a0that had devastated Medicare-\u00a0and Medicaid-participating facilities earlier in the pandemic.\u201d<\/p>\n<p class=\"gnt_ar_b_p\">However, two weeks ago, the CDC<a class=\"gnt_ar_b_a\" href=\"https:\/\/finance.yahoo.com\/1-cdc-cuts-quarantine-time-235657487-163530919.html\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">\u00a0changed its previous guidance<\/a>\u00a0on health care workers isolating after testing positive for COVID-19, and\u00a0said the quarantine time can be cut further if there are staffing shortages. Now, some <a class=\"gnt_ar_b_a\" href=\"https:\/\/www.businessinsider.com\/nurses-with-covid-say-they-are-being-told-to-work-2022-1\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">COVID-19-positive nurses<\/a>\u00a0across the country are being told to come into work and treat patients, even if they still have symptoms.<\/p>\n<p class=\"gnt_ar_b_p\"><strong>According to the Biden administration&#8217;s policies, it is better for hospital patients to be treated by <a class=\"gnt_ar_b_a\" href=\"https:\/\/www.wpri.com\/target-12\/covid-positive-health-care-workers-called-into-work-in-rhode-island\/\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">COVID-positive nurses and workers<\/a>\u00a0(whose COVID-19 vaccinations failed to safeguard them from the virus) than by unvaccinated nurses with no COVID.<\/strong><\/p>\n<p class=\"gnt_ar_b_p\">The new policy is outraging nurses across the nation. Zenei Triunfo-Cortez, president of National Nurses United, denounced the new policy: \u201cWeakening COVID-19 guidance now, in the face of what could be the\u00a0most devastating COVID-19 surge yet, will <a class=\"gnt_ar_b_a\" href=\"https:\/\/finance.yahoo.com\/1-cdc-cuts-quarantine-time-235657487-163530919.html\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">only result in further transmission, illness\u00a0and death<\/a>.\u201d<\/p>\n<p class=\"gnt_ar_b_p\"><strong>Vaccination status has gone from being a proxy for health to being a substitute for sane health care policy.<\/strong><\/p>\n<figure class=\"gnt_em gnt_em_img\"><img decoding=\"async\" class=\"gnt_em_img_i\" src=\"https:\/\/www.gannett-cdn.com\/presto\/2022\/01\/06\/USAT\/76a659b7-ff41-4e3b-aadc-6393ac2f68af-Bovard.jpg?width=459&amp;height=336&amp;fit=crop&amp;format=pjpg&amp;auto=webp\" alt=\"James Bovard in Washington, D.C., in May 2016.\" data-g-r=\"lazy\" \/><\/figure>\n<p class=\"gnt_ar_b_p\">Biden\u2019s COVID-19 policy continues to ignore a torrent of evidence undercutting its mandates.<\/p>\n<p class=\"gnt_ar_b_p\">Biden recently <a class=\"gnt_ar_b_a\" href=\"https:\/\/www.whitehouse.gov\/briefing-room\/speeches-remarks\/2021\/12\/21\/remarks-by-president-biden-on-the-fight-against-covid-19\/\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">declared<\/a> that &#8220;almost everyone who has died\u00a0from COVID-19 in the past many months\u00a0has been unvaccinated.\u201d But the <a class=\"gnt_ar_b_a\" href=\"https:\/\/www.oregon.gov\/oha\/covid19\/Documents\/DataReports\/Breakthrough-Case-Report.pdf\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">fully vaccinated accounted for\u00a021% to 27%\u00a0of COVID-19 fatalities in Oregon<\/a> from August through November; <a class=\"gnt_ar_b_a\" href=\"https:\/\/www.wcax.com\/2021\/10\/29\/vermonts-october-infections-break-pandemic-record\/\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">40% to nearly 75% of deaths in Vermont<\/a> from August into October.<\/p>\n<p class=\"gnt_ar_b_p\">In a recent television interview, Biden declared, \u201c<a class=\"gnt_ar_b_a\" href=\"https:\/\/www.whio.com\/news\/local\/exclusive-news-center-7-sits-down-one-on-one-with-president-joe-biden\/I4DCECFX4JDDTOC2BMWMB6XTAE\/\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">How about you make sure you\u2019re vaccinated<\/a>, so you do not spread the disease to anyone else.\u201d But CDC Director Rochelle Walensky <a class=\"gnt_ar_b_a\" href=\"https:\/\/www.stardem.com\/news\/national\/cdc-covid-vaccines-won-t-stop-transmission-fully-vaccinated-can-still-get-spread-delta-strain\/article_5f83d0cb-8b0a-535d-bbad-3f571754e5ae.html\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">admitted<\/a> in August: &#8220;What (COVID-19 vaccines)\u00a0can&#8217;t do anymore is prevent transmission\u00a0.&#8221;<\/p>\n<aside class=\"gnt_m gnt_x gnt_x__lbl gnt_x__al\" aria-label=\"advertisement\">\n<div id=\"ad-slot-7103-usatoday-native-article_link-opinion-2\" class=\"gnt_x_sl gnt_x_al\" data-g-r=\"lazy\" data-gl-method=\"lazyLoadX\" data-google-query-id=\"CIOHioHpn_UCFREJ0AQdpyIJHw\">\n<div id=\"google_ads_iframe_7103\/usatoday\/native-article_link\/opinion_0__container__\"><iframe id=\"google_ads_iframe_7103\/usatoday\/native-article_link\/opinion_0\" tabindex=\"0\" title=\"3rd party ad content\" role=\"region\" name=\"google_ads_iframe_7103\/usatoday\/native-article_link\/opinion_0\" width=\"970\" height=\"250\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\" aria-label=\"Advertisement\" data-google-container-id=\"2\" data-integralas-id-bd6bce27-b0d1-750c-846c-725167acb726=\"\" data-load-complete=\"true\" data-mce-fragment=\"1\"><\/iframe><\/div>\n<\/div>\n<\/aside>\n<p class=\"gnt_ar_b_p\">Biden recently <a class=\"gnt_ar_b_a\" href=\"https:\/\/www.newsweek.com\/joe-biden-abc-news-omicron-failure-laugh-tests-covid-1662545\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">responded<\/a> to the record breaking number of new COVID\u00a0cases by saying that &#8220;nobody\u00a0saw (the omicron variant)\u00a0coming.\u201d Many<a class=\"gnt_ar_b_a\" href=\"https:\/\/www.nytimes.com\/2021\/05\/12\/science\/covid-variant-mutation-tracking.html\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">\u00a0scientists had warned\u00a0of new variants<\/a>, but that apparently never showed up on the White House radar screen. The chaos from the surge in cases has been compounded by Biden\u2019s failure to <a class=\"gnt_ar_b_a\" href=\"https:\/\/www.nytimes.com\/2021\/12\/22\/us\/politics\/covid-tests-biden-omicron.html\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">fulfill his pledge<\/a> for easy accessibility to COVID-19 tests.<\/p>\n<p class=\"gnt_ar_b_p\">Vaccines can provide protection against COVID-19 for the elderly and high-risk groups, but there is insufficient evidence to justify forcibly injecting the nation at large. Almost a year ago, Biden promised in his inaugural address to &#8220;<a class=\"gnt_ar_b_a\" href=\"https:\/\/www.whitehouse.gov\/briefing-room\/speeches-remarks\/2021\/01\/20\/inaugural-address-by-president-joseph-r-biden-jr\/\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">overcome this deadly virus<\/a>.&#8221;\u00a0Biden <a class=\"gnt_ar_b_a\" href=\"https:\/\/www.whitehouse.gov\/briefing-room\/speeches-remarks\/2021\/12\/27\/remarks-by-president-biden-at-covid-19-response-teams-regular-call-with-the-national-governors-association\/\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">admitted last month <\/a>that there is \u201cno federal solution (to COVID-19).
