Post: The FBI just got caught in yet more massive, outrageous FISA abuses"},"content":{"rendered":"<p>New York Post, May 22, 2023<a href=\"https:\/\/jimbovard.com\/blog\/wp-content\/uploads\/2023\/05\/Screenshot-2023-05-22-at-10-00-44-The-New-York-Post-e-Edition.png\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-18322\" src=\"https:\/\/jimbovard.com\/blog\/wp-content\/uploads\/2023\/05\/Screenshot-2023-05-22-at-10-00-44-The-New-York-Post-e-Edition-800x512.png\" alt=\"\" width=\"700\" height=\"448\" srcset=\"https:\/\/jimbovard.com\/blog\/wp-content\/uploads\/2023\/05\/Screenshot-2023-05-22-at-10-00-44-The-New-York-Post-e-Edition-800x512.png 800w, https:\/\/jimbovard.com\/blog\/wp-content\/uploads\/2023\/05\/Screenshot-2023-05-22-at-10-00-44-The-New-York-Post-e-Edition-1024x656.png 1024w, https:\/\/jimbovard.com\/blog\/wp-content\/uploads\/2023\/05\/Screenshot-2023-05-22-at-10-00-44-The-New-York-Post-e-Edition-150x96.png 150w, https:\/\/jimbovard.com\/blog\/wp-content\/uploads\/2023\/05\/Screenshot-2023-05-22-at-10-00-44-The-New-York-Post-e-Edition-768x492.png 768w, https:\/\/jimbovard.com\/blog\/wp-content\/uploads\/2023\/05\/Screenshot-2023-05-22-at-10-00-44-The-New-York-Post-e-Edition.png 1176w\" sizes=\"auto, (max-width: 700px) 100vw, 700px\" \/><\/a><\/p>\n<h1 class=\"headline headline--single\"><a href=\"https:\/\/nypost.com\/2023\/05\/21\/the-fbi-just-got-caught-in-yet-more-massive-outrageous-fisa-abuses\/\">The FBI just got caught in yet more massive, outrageous FISA abuses<\/a><\/h1>\n<p>by James Bovard<\/p>\n<p><strong>Like the casino-gambling scene in \u201cCasablanca,\u201d the Foreign Intelligence Surveillance Act court is \u201cshocked, shocked\u201d the Federal Bureau of Investigation continues to ravage the privacy of vast numbers of Americans.<\/strong><\/p>\n<p><strong>For each American the FISA court permitted the FBI to target, the bureau illicitly surveilled almost 1,000 additional Americans.<\/strong><\/p>\n<p><strong>The court\u2019s just-revealed ruling signals the FBI presumed any American suspected of supporting the Jan. 6, 2021, protests forfeited his constitutional rights.<\/strong><\/p>\n<p>FISA was enacted in 1978 to curb the rampant illegal political spying exposed during the Nixon administration.<\/p>\n<p>After the 9\/11 attacks, the Bush administration decided the president was entitled to order the National Security Agency to vacuum up Americans\u2019 and foreigners\u2019 emails and other data without a warrant.<\/p>\n<p>Federal judges disagreed, and the result was a 2008 FISA reform that authorized the feds to continue commandeering vast amounts of data.<\/p>\n<p>But under Section 702 of that law, the FBI was permitted to conduct warrantless searches of that stash for Americans\u2019 data only to seek foreign intelligence information or evidence of crime.<\/p>\n<p>The heavily redacted 2022 opinion finally released Friday revealed the FBI <a href=\"https:\/\/nypost.com\/2023\/05\/20\/fbi-issued-278000-improper-searches-in-2021-filings\/\">conducted 278,000 improper<\/a> searches of Americans in 2020 and early 2021.<\/p>\n<p><strong>Incredibly, the bureau conducted roughly 3.4 million warrantless searches of Americans in 2021 via Section 702.<\/strong><\/p>\n<p>The day before, Thursday, an FBI whistleblower revealed in congressional testimony that FBI headquarters <a href=\"https:\/\/nypost.com\/2023\/05\/18\/democrats-attack-fbi-whistleblowers-giving-cover-to-the-agencys-abuses\/\">pressured agents<\/a> to treat anyone who attended the Jan. 6 protests as a criminal suspect.<\/p>\n<aside class=\"single__inline-module alignleft\">\n<div class=\"inline-module inline-module--related-post\">\n<div class=\"inline-module__inner\">\n<h2 class=\"inline-module__heading widget-heading widget-heading--underline\"><\/h2>\n<\/div>\n<\/div>\n<\/aside>\n<p>The FISA court opinion reveals the FBI wrongfully cast a far broader net.\u00a0 Roughly 2,000 pro-Trump protesters (including an unknown number of undercover agents and informants) entered the Capitol that day. But an FBI analyst exploited FISA to unjustifiably conduct searches on 23,132 Americans citizens \u201cto find evidence of possible foreign influence, although the analyst conducting the queries had no indications of foreign influence,\u201d according to FISA Chief Judge Rudolph Contreras.<\/p>\n<p>The court ruling did not disclose the standards (if any) the FBI used for its warrantless Jan. 6 searches. Did Twitter retweets suffice?<\/p>\n<p>It gets worse. The FBI exploited FISA to target 19,000 donors to the campaign of an unnamed candidate who challenged an incumbent member of Congress. An FBI analyst justified the warrantless searches by claiming \u201cthe campaign was a target of foreign influence,\u201d but even the Justice Department concluded almost all those searches violated FISA rules. (In March, Rep. Darin LaHood (R-Ill.) revealed he had been <a href=\"https:\/\/lahood.house.gov\/2023\/3\/lahood-addresses-violations-and-need-for-fisa-reform\">wrongly targeted<\/a> by the FBI in numerous FISA 702 searches \u2014\u00a0but he wasn\u2019t the challenger mentioned here.)<\/p>\n<p>The FBI also conducted secret searches of the emails and other data of 133 people arrested during the 2020 protests after George Floyd\u2019s killing.<\/p>\n<p>And the bureau conducted 656 warrantless searches to see if it could find any derogatory information on people it planned to use as informants.<\/p>\n<p>The FBI also routinely conducted warrantless searches on <strong>\u201c<\/strong>individuals listed in police homicide reports, including victims, next-of-kin, witnesses, and suspects.\u201d Even the Justice Department complained those searches were improper.<\/p>\n<p>This is only the latest in a long series of FBI FISA scandals. In April 2021, the FISA court reported the FBI conducted warrantless searches of the data trove for \u201cdomestic terrorism,\u201d \u201cpublic corruption and bribery,\u201d \u201chealth care fraud\u201d and other targets \u2014 including people who notified the FBI of crimes and even repairmen entering FBI offices.<\/p>\n<p>If you sought to report a crime to the FBI, an FBI agent may have illegally surveilled your email. Even if you merely volunteered for the FBI \u201cCitizens Academy\u201d program, the FBI may have illegally tracked all your online activity.<\/p>\n<p><strong>The FISA court treats the FBI like New York City judges treat serial shoplifters. <\/strong>Going back more than 20 years, FISA court rulings have complained of FBI agents lying to the court and abusing the law.<\/p>\n<p><strong>As long as the FBI periodically promises to repent, the FISA court entitles it to continue decimating the Fourth Amendment.<\/strong><\/p>\n<p><strong>Federal intelligence agencies refuse to even estimate how many Americans\u2019 private data have been rounded up in government databases.<\/strong><\/p>\n<p><strong>There is no reason to presume the feds have disclosed all their FISA wrongdoing. Prior to Edward Snowden\u2019s leaks, the feds probably admitted fewer than 1% of federal surveillance abuses.<\/strong><\/p>\n<p>Section 702 will expire this year unless Congress reauthorizes the provisio<strong>n. But the FBI\u2019s perpetual crime wave has created a hornet\u2019s nest on Capitol Hill.<\/strong><\/p>\n<p>Rep. Andy Biggs (R-Ariz.) asked: \u201cHow much longer must we watch the FBI brazenly spy on Americans before we strip it of its unchecked authority?\u201d<\/p>\n<p>Rep. Mike Garcia (R-Calif.) declared, \u201cWe need a pound of flesh. We need to know someone has been fired.\u201d<\/p>\n<p>Even Rep. Jerry Nadler (D-Manhattan), the House Judiciary Committee\u2019s ranking Democrat, opposes reauthorizing Section 702 without fundamental reforms.<\/p>\n<p><strong>Perhaps FISA should be renamed the \u201cTrust Me, Chumps!\u201d Surveillance Act. The FISA court has perpetually dismally failed to defend Americans\u2019 constitutional rights.
