TSA has stripped more than 10,000 travelers of their money since 2014, but the supposed \u201ccriminals\u201d are almost never charged after their cash is taken.<\/strong> A class-action federal court case could finally end this outrage.<\/p>\n<p><strong>\u201cTSA has secret policies that tell its screeners that they must seize travelers&#8217; cash,\u201d Dan Alban, t<\/strong>he lawyer leading a nationwide class-action suit against the agency, tells me. Alban is with the Institute for Justice, which is fighting to stop airport checkpoints from being Constitution-free zones.<\/p>\n<p>Federal law prohibits travelers from taking more than $10,000 in cash out of or into the United States without filling out an official form. But traveling inside America with hefty amounts of cash is perfectly legal. That doesn\u2019t stop<strong> TSA from plundering passengers on any and every BS pretext.<\/strong><\/p>\n<p>Alban appeared in federal court this month to argue his case in Pittsburgh with Rebecca Brown, the lead plaintiff. In <a href=\"https:\/\/webmail.his.com\/calendar\/day\/1564691670329\">August 2019<\/a>, 57-year-old Brown was flying out of Pittsburgh International Airport carrying her father\u2019s life savings \u2014 $82,373 \u2014 which he wanted her to deposit in a joint bank account near her Boston home. A TSA agent noticed the Tupperware loaded with the cash while scanning Brown\u2019s luggage and summoned a Drug Enforcement Administration agent, who speedily announced he was seizing the money. There was never any allegation Brown came by the money illegally. After the media <a href=\"https:\/\/74d1c5e3.streak-link.com\/CxLV3AwKyld6amAOLAsxj7mE\/https%3A%2F%2Fwww.washingtonpost.com%2Flocal%2Fpublic-safety%2Fthe-dea-seized-her-fathers-life-savings-at-an-airport-without-alleging-any-crime-occurred-lawsuit-says%2F2020%2F01%2F15%2F1d9986e6-36e6-11ea-bb7b-265f4554af6d_story.html\">publicized<\/a> a lawsuit challenging the seizure, the TSA returned the money seven months later. But legions of similar travelers continue to be victimized across the land.<\/p>\n<p>TSA agents were sometimes <a href=\"https:\/\/74d1c5e3.streak-link.com\/CxLV3AsJif5PNby1ZwQJaToQ\/https%3A%2F%2Fij.org%2Fdea-offered-reward-tsa-screener-help-seize-cash-luggage%2F\">permitted to keep a percentage<\/a> of travelers\u2019 cash they helped seize, but that brazen abuse reportedly no longer occurs. Until recently, TSA seizure efforts partnered with the Drug Enforcement Agency, whose asset-forfeiture program\u2019s <a href=\"https:\/\/74d1c5e3.streak-link.com\/CxLV3AwOjjA0DeQNswNAcqk8\/https%3A%2F%2Fwww.washingtonpost.com%2Fnews%2Fwonk%2Fwp%2F2015%2F05%2F15%2Fhow-the-irs-seized-a-north-carolina-businessmans-life-savings-without-ever-charging-him-with-a-crime%2F\">unofficial motto<\/a> is \u201cYou make it, we\u2019ll take it.\u201d The government doesn\u2019t have to prove the person is guilty. Instead, the feds simply take the cash, and private citizens must engage in a long, expensive fight to attempt to get their money back.<\/p>\n<p><strong>TSA cash seizures are arbitrary power at its worst<\/strong>. Though TSA considers travelers carrying \u201cbulk cash\u201d to be a great evil, the agency refuses to limit its power by defining the menace. TSA \u201ccleverly leaves the definition of a large amount of cash up to the individual TSA screener,\u201d Alban notes.<\/p>\n<p>TSA agents in Indiana are encouraged to \u201ctrust your instinct\u201d when it comes to commandeering passengers\u2019 money. North Dakota TSA agents are told, \u201cAny large amount of currency will be reported, even if you believe it to be in the low thousands.\u201d<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Airport cash seizures are turbocharged because TSA considers almost everything to be \u201cevidence of criminal activity.\u201d<\/strong> TSA agents can seize money if it is \u201cRubber Banded,\u201d bundled in \u201cStore Bought Bands\u201d or bundled with \u201cHand Made Bands.\u201d If there is a \u201cHand Made Label\u201d on the cash, then it is guilty as hell or at least \u201cclose enough for government work\u201d guilty. TSA agents can seize money if it is suspiciously all the same denomination of currency \u2014 or if it is suspiciously of different denominations. Carrying any money <a href=\"https:\/\/74d1c5e3.streak-link.com\/CxLV3AwZWYJ8iLD-cwav3UeG\/https%3A%2F%2Fij.org%2Fwp-content%2Fuploads%2F2020%2F01%2FECF-175-Pls.-Statement-of-Undisputed-Material-Facts-and-Response-to-Defs.-SUMF-REDACTED.pdf\">in your socks<\/a> is treated like a full confession.<\/p>\n<p><strong>TSA condemns travelers for concealing money even though more than 500 TSA agents have been fired for robbing passengers<\/strong>. I hammered that <a href=\"https:\/\/74d1c5e3.streak-link.com\/CxLV3AsTEx2VcUl8Cgu_oBEX\/https%3A%2F%2Fwww.nytimes.com%2F2004%2F08%2F18%2Fopinion%2Fbag-it.html\">nationwide looting spree<\/a> in a 2004 New York Times op-ed. Remember the Newark TSA agent who <a href=\"https:\/\/74d1c5e3.streak-link.com\/CxLV3A8SUuj4_F2a5wGu0EG6\/https%3A%2F%2Fwww.nj.com%2Fnews%2F2009%2F03%2Fextsa_worker_admits_stealing_f.html\">confessed to selling<\/a> on eBay scores of laptops, cameras and cellphones he stole from travelers? Three TSA agents were busted for stealing in Miami in 2023, <a href=\"https:\/\/74d1c5e3.streak-link.com\/CxLV3AwCghDG5PAvmgMUib-z\/https%3A%2F%2Fnypost.com%2F2023%2F09%2F14%2Fflorida-tsa-officers-seen-stealing-from-passengers-at-security-checkpoint-at-miami-airport%2F\">The Post reported<\/a>, and one admitted seizing a thousand dollars a day from wallets sent through TSA X-ray systems.<\/p>\n<p>At some airports, TSA agents rely on \u201cbehavior detection\u201d checklists to target travelers for extra scrutiny. The current checklist is secret, but TSA agents previously zeroed in on anyone who \u201c<a href=\"https:\/\/74d1c5e3.streak-link.com\/CxLV3A0HR9U2alwWHQa8y8F3\/https%3A%2F%2Freason.com%2F2016%2F05%2F22%2Fthe-4-trillion-war-on-terror%2F\">expresses contempt<\/a> against airport passenger procedures.\u201d<strong> If someone gets riled up after TSA takes his money, does that prove he was up to no good?<\/strong><\/p>\n<p>I didn\u2019t realize until I read about this lawsuit how close I came to getting shafted <a href=\"https:\/\/74d1c5e3.streak-link.com\/CxLV3AwV1QTUlx7B3wLJ9kd9\/https%3A%2F%2Fwww.latimes.com%2Fopinion%2Fop-ed%2Fla-oe-bovard-tsa-watchlist-20180528-story.html\">at Washington National Airport<\/a> in 2018.<\/p>\n<p>After I forgot to remove my belt before entering the whole-body scanner, I endured a groin-jabbing \u201cenhanced patdown.\u201d Then the bleary-eyed TSA agent announced: \u201cI need to see your wallet.\u201d<\/p>\n<p>\u201cWhat the heck?!?\u201d I said. I didn\u2019t want to miss my flight to Atlanta, so I handed him my billfold.<\/p>\n<p>The TSA screener laboriously leafed through each bill in my wallet. Was he checking if I was transporting prohibited Confederate currency or maybe Iranian rials?<\/p>\n<p>I had a few hundred dollars in the wallet but apparently not enough for him to declare victory and\u00a0pilfer me.\u00a0He also insisted on taking out each credit card to check if it had a sharp edge that I could use like a knife. I wondered where TSA found these wizards.<\/p>\n<p>And then another TSA agent came up and rummaged in my carry-on bag and proudly announced he was seizing my cigar cutter \u2014 even though the TSA website said it was permitted. Happily, the agent missed my backup cigar cutter in the same bag so my trip wasn\u2019t ruined.<\/p>\n<p><strong>The class-action lawsuit is a great opportunity to shred the iron curtain unjustifiably shielding many abusive or idiotic TSA policie<\/strong>s. \u201cThere is all kind of stuff that TSA considers to be Sensitive Security Information that is laughable and nobody would consider this secret,\u201d Alban observes \u2014\u00a0even \u201cmany basic procedures and methods that all air travelers are familiar with.\u201d<\/p>\n<p>Maybe TSA will even confess the stunning defects of its scanners \u2014 which The Post reported last summer set off a cavalcade of embarrassing false alarms for women with <a href=\"https:\/\/74d1c5e3.streak-link.com\/CxLV3A0EhFopnWP57QrxhfOv\/https%3A%2F%2Fnypost.com%2F2025%2F06%2F30%2Flifestyle%2Fmy-sweaty-crotch-set-off-tsa-alarm-at-airport-security-passenger%2F%3Futm_campaign%3Dnypost%26utm_medium%3Dsocial%26utm_source%3Dtwitter\">&#8220;swamp crotch<\/a>&#8221; (moisture in the pelvic area).<\/p>\n<p>TSA victim Rebecca Brown nailed the outrage: \u201cThe government shouldn\u2019t be able to take <a href=\"https:\/\/74d1c5e3.streak-link.com\/CxLV3A4t7UC0a-ScjQ0TxufA\/https%3A%2F%2Fij.org%2Fpress-release%2Fpittsburgh-retiree-to-finally-get-life-savings-back-from-the-federal-government%2F\">money for no<\/a> reason. . . .
