House Speaker Paul Ryan and others are claiming victory over the <a href=\"http:\/\/thehill.com\/policy\/finance\/263405-read-omnibus-spending-bill-text\">2,000-plus\u00a0page<\/a> appropriations bill, but this is a \u201cno boondoggle left behind\u201d <a href=\"http:\/\/www.usatoday.com\/story\/news\/politics\/2014\/12\/16\/obama-signs-spending-bill\/20513255\/\">$1.1 trillion<\/a> nightmare.<\/p>\n<p>House Appropriations Committee Chairman Hal Rogers&#8217; press release claims that the omnibus bill \u201c<a href=\"http:\/\/appropriations.house.gov\/news\/documentsingle.aspx?DocumentID=394337\">helps to stop waste and administrative overreach<\/a>.\u201d Instead, the bill ravages both paychecks and freedom. No wonder White House spokesman\u00a0Josh Earnest gushed Wednesday: \u201c<a href=\"https:\/\/www.whitehouse.gov\/the-press-office\/2015\/12\/16\/press-briefing-press-secretary-josh-earnest-12162015\">We feel good about the outcome<\/a>.\u201d<\/p>\n<p>Here\u2019s the tip of the iceberg of the bill\u2019s outrages:<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>The bill <a href=\"http:\/\/thehill.com\/policy\/energy-environment\/263447-spending-bill-wont-stop-funds-for-obama-climate-deal\">fails to block<\/a>\u00a0President\u00a0Obama from delivering up to $3 billion to the United Nations Green Climate Fund, a <a href=\"http:\/\/unfccc.int\/cooperation_and_support\/financial_mechanism\/green_climate_fund\/items\/5869.php\">partial product<\/a> of the Paris climate summit. Republicans initially planned to block such funding unless the Senate was permitted to vote on the U.N. climate treaty.\u00a0But since the omnibus bill failed to prohibit such payments, Obama will soon deliver $500 million in U.S. tax money to the fund \u2014 despite the legendary record of U.N. programs for corruption worse than Chicago.<\/li>\n<li>The bill <a href=\"http:\/\/thehill.com\/policy\/energy-environment\/226575-spending-bill-would-block-protection-efforts-for-at-risk-bird\">fails to block<\/a> perhaps the Environmental Protection Agency\u2019s greatest land grab\u00a0\u2014 its \u201cwaters of the United States\u201d decree that seizes federal jurisdiction over <a href=\"http:\/\/thinkprogress.org\/climate\/2015\/09\/18\/3703024\/senate-republicans-disapprove-of-waters-rule\/%20%5B20%20million%20acres\/#%5D\">20 million acres<\/a> that are sometimes wet. The EPA\u2019s wetland crackdowns <a href=\"http:\/\/www.wsj.com\/articles\/u-s-appeals-court-blocks-epa-water-rule-nationwide-1444400506\">have been trounced<\/a> by numerous judges. Republicans faltered even though the <a href=\"http:\/\/www.gao.gov\/products\/B-326944\">Government Accountability Office reported Monday<\/a> that EPA had engaged in illegal \u201ccovert propaganda\u201d to promote this policy.<\/li>\n<li>It provides more than <a href=\"http:\/\/www.usatoday.com\/story\/military\/2015\/12\/16\/budget-omnibus-fy16-defense-veterans-affairs-pentagon\/77416466\/\">$3.7 billion for economic and military aid<\/a> to Afghanistan,\u00a0though an Agency for International Development <a href=\"http:\/\/www.nytimes.com\/2015\/12\/16\/us\/politics\/afghans-see-taliban-as-a-key-to-us-aid-projects-study-finds.html\">study recently warned<\/a> that some projects \u201cactually had the perverse effect of increasing support for the Taliban.\u201d\u00a0Afghan relief continues to be a hopeless mess; the AID inspector general reported last week that the agency\u2019s highly\u00a0touted new monitoring system was <a href=\"https:\/\/oig.usaid.gov\/sites\/default\/files\/audit-reports\/f-306-16-001-p.pdf\">used for less than 1% of grants and contracts<\/a>.<\/li>\n<li>It <a href=\"http:\/\/democrats.appropriations.house.gov\/sites\/democrats.appropriations.house.gov\/files\/wysiwyg_uploaded\/Summary%20of%20FY16%20Omnibus_0.pdf\">fails to block<\/a> the imminent proclamation of Food and Drug Administration regulations that could <a href=\"http:\/\/www.usatoday.com\/story\/opinion\/2014\/06\/22\/cigar-smokers-fda-tobacco-regulations-column\/11242667\/\">severely impact the sale<\/a> of most of the cigars\u00a0now marketed in the U.S.,\u00a0as well as ravaging the burgeoning e-cigarette industry (which experts say\u00a0provides a healthier alternative to cigarettes).<\/li>\n<li>The omnibus bill failed to include a provision to end <a href=\"http:\/\/oversight.house.gov\/wp-content\/uploads\/2014\/05\/Staff-Report-Operation-Choke-Point1.pdf\">Operation Choke Point<\/a>, a Justice Department-Federal Deposit Insurance Corporation&#8217;s\u00a0crackdown that pressured banks to cancel the accounts of gun stores, coin dealers, payday lenders\u00a0and other disfavored industries in what <a href=\"http:\/\/thehill.com\/policy\/finance\/236805-house-republicans-demand-fdic-punish-operation-choke-point-operators\">Rep. Sean Duffy,\u00a0R-Wis.,\u00a0derided<\/a> as \u201cweaponizing government to meet their ideological beliefs.\u201d<\/li>\n<li>The average federal worker\u00a0is already paid\u00a0more than <a href=\"http:\/\/www.downsizinggovernment.org\/federal-worker-pay\">$100,000 a year<\/a> in total compensation,\u00a0but the budget deal failed to block Obama from giving them <a href=\"http:\/\/federalnewsradio.com\/budget\/2015\/12\/pay-raise-transit-benefits-parity-gives-feds-optimism-2016\/\">a\u00a01.3% raise<\/a> \u2014 though many, if not most, taxpayers received zilch raise this year.<\/li>\n<li>The bill <a href=\"http:\/\/www.usatoday.com\/story\/news\/politics\/2015\/12\/16\/congress-reaches-11-trillion-spending-deal-plus-billions-tax-cuts\/77410914\/\">extends<\/a> the earned income tax credit without reforming it \u2014 though the <a href=\"http:\/\/taxfoundation.org\/blog\/earned-income-tax-credit-still-plagued-high-error-rate\">IRS estimates<\/a> that up to 25% of all handouts under the law are fraudulent or otherwise improper.<\/li>\n<li>The omnibus bill <a href=\"http:\/\/democrats.appropriations.house.gov\/sites\/democrats.appropriations.house.gov\/files\/wysiwyg_uploaded\/Summary%20of%20FY16%20Omnibus_0.pdf\">dropped a House provision<\/a> that would have <a href=\"http:\/\/www.eatrightpro.org\/resource\/news-center\/on-the-pulse-of-public-policy\/from-the-hill\/threats-to-the-dga\">required stronger evidence<\/a> for federally\u00a0proclaimed Dietary Guidelines for Americans.\u00a0Earlier\u00a0official guidelines have been <a href=\"http:\/\/www.nytimes.com\/2015\/07\/09\/opinion\/why-is-the-federal-government-afraid-of-fat.html\">widely discredited<\/a> and are often blamed for contributing to the nation\u2019s obesity crisis, but the same dubious evidence standard can be used in the future.<\/li>\n<li>The bill provides almost <a href=\"http:\/\/appropriations.house.gov\/uploadedfiles\/12.15.15_fy_2016_omnibus_-_thud_-_summary.pdf\">$27 billion<\/a> for public housing and Section 8.\u00a0That includes an almost half a billion dollar increase for subsidized rental vouchers, despite the long <a href=\"http:\/\/www.usatoday.com\/story\/opinion\/2015\/05\/25\/baltimore-housing-hud-subsidies-mortgage-column\/27494811\/\">record of havoc<\/a> in neighborhoods where recipients cluster.\u00a0The omnibus bill <a href=\"http:\/\/nlihc.org\/article\/update-fy16-omnibus-spending-bill-released\">also dropped<\/a> provisions to curb the Department of Housing and Urban Development from bankrolling fair housing <a href=\"http:\/\/www.american-apartment-owners-association.org\/property-management\/latest-news\/lawyer-says-fair-housing-fines-amount-to-extortion\/\">entrapment-like operations<\/a> or enforcing new regulations to bludgeon localities with a lower percentage of minorities than the national averages.<\/li>\n<li>Some provisions of the bill seem harebrained even by Beltway standards. Republicans were justifiably outraged by the Bureau of\u00a0Alcohol, Tobacco, Firearms and Explosives&#8217; &#8220;fast and furious&#8221; operation, which authorized sending more than a <a href=\"http:\/\/usatoday30.usatoday.com\/news\/washington\/2011-08-08-ATF-guns-Operation-Fast-and-Furious-Congress_n.htm\">thousand guns<\/a> to Mexican drug cartels.\u00a0<a href=\"http:\/\/file\/\/\/C:\/Users\/telston\/Downloads\/293404669-Read-omnibus-spending-bill-text.pdf\">Section 276 of the omnibus bill<\/a> prohibits federal agents from providing guns to anyone he &#8220;knows or suspects &#8230; is an agent of a drug cartel, unless law enforcement personnel of the United States continuously monitor or control the firearm at all times.&#8221;\u00a0So the G-man is supposed to keep his finger on the suspect\u2019s trigger at all times, or what? Perhaps it would be too easy to cease giving weapons to drug dealers.<\/li>\n<li>Perhaps the most appalling part of the omnibus are the provisions that authorize tech and communication companies to secretly provide your personal data to federal agencies \u2014 no search warrant required. The American Civil Liberties Union warns that this information \u201ccan be used for criminal prosecutions unrelated to cyber security, including the targeting of whistle-blowers under the Espionage Act.\u201d Rep. <strong>Justin Amash<\/strong>,\u00a0R-Mich.,\u00a0<a href=\"https:\/\/twitter.com\/justinamash\/status\/677179396554416128\">rightly warns<\/a> that a vote for the omnibus bill is a \u201cvote to support unconstitutional surveillance on law-abiding Americans.\u201d<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<div><\/div>\n<\/div>\n<p>While Congress made scant effort to protect average Americans from rampaging regulators, it hustled to include a provision requesting the <a href=\"http:\/\/hoh.rollcall.com\/congress-approves-of-capitol-sledding\/\">Capitol Police to permit sledding<\/a> on Capitol Hill. The \u201c<a href=\"http:\/\/blogs.wsj.com\/washwire\/2015\/12\/16\/capitol-hill-sledding-a-big-winner-in-spending-deal\/\">sled free or die<\/a>\u201d provision was a \u201c<a href=\"https:\/\/www.washingtonpost.com\/news\/powerpost\/wp\/2015\/12\/16\/heres-what-made-it-into-congresss-big-tax-and-spending-bills\/\">bipartisan win<\/a>,\u201d according to <em>The Washington Post<\/em>.\u00a0It is regrettable that there was little or no bipartisan interest in curbing federal power beyond spitting distance from the Capitol Dome.<\/p>\n<p>House Freedom Caucus member Tim Huelskamp,\u00a0R-Kan.,\u00a0<a href=\"http:\/\/www.washingtonpost.com\/news\/the-fix\/wp\/2015\/12\/16\/the-good-news-for-paul-ryan-conservatives-dont-see-him-as-boehner-2-0\/\">summarized<\/a> the GOP\u00a0leadership&#8217;s wacky reasoning: \u201cGive the Democrats what they want now so next time they won\u2019t want as much.\u201d Republicans have been thunderously promising for decades to protect Americans against federal waste, fraud\u00a0and abuse.
